TPO – The Government Inspectorate concluded that the Hanoi People's Committee allowed business units under the Ministry of Transport to convert the land use purpose at 53 Trieu Khuc and 44 Trieu Khuc (Thanh Xuan district) for housing projects in violation of regulations.

The Government Inspectorate (GIA) has just announced the conclusion of the inspection of the restructuring of state-owned enterprises; conversion of land use purposes from production and business of state-owned enterprises, equitized enterprises to land business, housing construction (period 2011 - 2021) at the Ministry of Transport (MOT). The GIA concluded that there were up to 12 land lots and real estate facilities with violations, of which, there were 2 land lots at 53 and 44 Trieu Khuc (Thanh Xuan district) located opposite each other.

According to the inspection agency, the land and housing facility at km 9+500 Nguyen Trai (now 53 Trieu Khuc, Thanh Xuan district) of Hoa Binh Automobile Joint Venture Company Limited originated from the land allocated by the state to Hoa Binh Automobile Factory for a joint venture with a foreign country to build an automobile manufacturing and assembly factory (land use period of 30 years from 1992). However, the Hanoi People's Committee issued Decision No. 7122 dated December 27, 2014 allowing Hoa Binh Automobile Joint Venture Company Limited to change the purpose of using 44,024 m2 of land at 53 Trieu Khuc to residential, commercial, and office service land without rearranging the real estate facilities when the joint venture capital contribution period expires... At the same time, it did not report to the Prime Minister when changing the purpose of using land under Decision No. 129 dated April 17, 1992 of the Council of Ministers from automobile manufacturing and assembly plant to residential land.

Along with that, the Hanoi People's Committee issued Decision No. 7122 dated December 27, 2014 recognizing Hoa Binh Automobile Joint Venture Company Limited as the investor to implement the PANDORA Mixed-Use Complex project when the owner's equity only accounted for 17.47% of the total investment of the project, which is not in accordance with regulations.

In addition, the Hanoi People's Committee issued Decision No. 1642 dated April 17, 2015 determining land prices using the surplus method for comparable assets that do not have similar characteristics to the appraised asset; not forecasting and taking into account trends and fluctuations in market prices to estimate the project's selling price in accordance with reality; the selling price used in development revenue is only the individual price of the comparable asset and not the average price, which is not in accordance with regulations.

“Thus, the real estate at 53 Trieu Khuc has not been arranged by the Ministry of Transport and Hoa Binh Auto Joint Venture Company Limited according to regulations; the Hanoi People's Committee has changed the land use purpose and assigned the project to an enterprise that does not have sufficient financial capacity and has not received the opinion of competent authorities, and determined the land use fee is not in accordance with regulations,” the inspection conclusion clearly stated.

The responsibility for the above-mentioned existence belongs to the leaders of Hoa Binh Automobile Joint Venture Company, the Ministry of Transport and the Hanoi People's Committee.

Regarding the real estate facility at 44 Trieu Khuc Street, Thanh Xuan District (located opposite the land plot at 53 Trieu Khuc - PV) of Hoa Binh Automobile Mechanical Joint Stock Company, the Inspection Conclusion pointed out that the Hanoi People's Committee issued Decision No. 4683 dated September 6, 2018 allowing Hoa Binh Automobile Mechanical Joint Stock Company to change the purpose of using 6,129 m2 of land at 44 Trieu Khuc, which is not in accordance with the land use plan of Hoa Binh Automobile Factory at the time of equitization, but did not carry out the recovery and public auction, which is not in compliance with the provisions of Resolution No. 60/2018/QH14 dated June 15, 2018.

At the same time, the Hanoi People's Committee issued Decision No. 2629 dated May 20, 2019 determining land prices using the surplus method for comparable assets that do not have similar characteristics to the appraised asset; not forecasting and taking into account trends and fluctuations in market prices to estimate the project's selling price in accordance with reality; the selling price used in development revenue is only the individual price of the comparable asset and not the average price, which is not in accordance with regulations.

Thus, the land and housing facility at 44 Trieu Khuc Street was changed to a land use purpose by the Hanoi People's Committee not in accordance with the approved plan, the land was not recovered and auctioned, and the land use fee was not determined in accordance with regulations.

"The responsibility for the above-mentioned existence belongs to the leaders of Hoa Binh Automobile Mechanical Joint Stock Company and the Hanoi People's Committee," the inspection conclusion clearly stated.

Based on the Inspection Conclusion, the Government Inspector General requested the Hanoi People's Committee to inspect and review the change of land use purpose, determine the value of land use rights to collect additional funds to the state budget (if any) in accordance with the provisions of law; coordinate with the Ministry of Transport to inspect and review the procedures for capital contribution to joint ventures, associations, and project transfers related to land.
