(NLDO) - In 2025, Da Nang City will focus on resolving difficulties for projects and land issues included in inspection conclusions and court rulings.
On March 20th, the Da Nang City People's Committee held a conference to implement Conclusion 77 of the Politburo and Resolution 170 of the National Assembly on solutions to difficulties and obstacles related to projects and land in inspection, audit, and court rulings.
According to a report from the Da Nang City People's Committee, regarding projects and land areas on the Son Tra peninsula, the Department of Construction has consulted with relevant units to compile and submit to the City People's Committee for the cancellation of boundary maps for 5 projects that have not yet received land allocation. For the remaining 15 projects, the City People's Committee has directed the Department of Agriculture and Environment to compile and provide legal documents to relevant departments and agencies for review.
Many projects on Son Tra Peninsula will have their obstacles removed following the Politburo's Conclusion 77 and the National Assembly's Resolution 170.
At the Chi Lang Stadium project, the city must enforce the auction of 10 land use right certificates with a total amount of 4,132 billion VND to be enforced. Mr. Le Quang Nam, Vice Chairman of the Da Nang City People's Committee, said that the locality expects to hand over the cleared land no later than April 30th. Following this, the relevant agencies, including the Civil Enforcement Department and the Department of Agriculture and Environment, will adjust the land use term from residential land to 50 years. After that, the entire Chi Lang Stadium will be auctioned off.
Regarding the reclamation of the 3,264m2 plot of land on Ngo Quyen Street, Son Tra District, where the ABC Kindergarten was built, as stipulated in the appellate judgment of the Hanoi High Court, IVC Co., Ltd. has signed a land lease contract until May 2032.
The Party Committee of the Government requests the Politburo's approval to instruct the Da Nang City People's Committee to work with IVC Co., Ltd. to determine the remaining assets on the land and organize the lease of land use rights through auction. The winning bidder will be responsible for returning the assets to IVC Co., Ltd. In case of disagreement on the value of the assets on the land, the parties will file a lawsuit in the competent court.
In a general report on the progress of resolving issues related to projects and land, the Da Nang City People's Committee stated that the review and copying of original documents related to the issuance of land use right certificates will be completed in April. Approximately 90% of the documents have already been processed.
Regarding the task of reassessing land prices to recover financial obligations for lost revenue and exemptions, the City People's Committee has agreed on 3 out of 11 reports.
Regarding the recovery of the 5% and 10% exemptions and reductions in land use fees, the City People's Committee has issued 113 decisions out of a total of 254 cases and is currently reviewing 96 drafts.
The Da Nang Department of Agriculture and Environment is reviewing 39 applications from secondary investors who disagree with paying the financial obligations arising from the inspection findings.
Regarding the handling of cases where land is not put into use during the extension of land use deadlines, the City People's Committee has issued a Decision to extend deadlines for 113 land plots, and the People's Committees of districts and counties are currently inspecting 172 land plots belonging to individuals…
According to Mr. Le Trung Chinh, Chairman of the Da Nang City People's Committee, in 2025, the city will focus on implementing Conclusion 77 of the Politburo and Resolution 170 of the National Assembly.
Between 2012 and 2020, many projects and land issues in Da Nang were related to four conclusions of the Government Inspectorate and three criminal appeals judgments, leading to numerous complications.
The city has mobilized numerous resources and aggressively implemented remedial measures. However, during the implementation process, certain obstacles and impacts have been encountered because the issues and recommendations are very complex, have existed for many years and across multiple terms; and there are no existing legal regulations, mechanisms, or policies to address them.
In 2024, the Politburo issued Conclusion No. 77 and the National Assembly passed Resolution 170 on removing difficulties and obstacles related to projects and land in inspection, audit, and court rulings in some provinces and cities, including Da Nang City.
