The Ministry of Public Security said that in cases of using highly lethal knives for work, production, or daily life, there is no need to declare.
On June 3, the 7th session of the 15th National Assembly continued to work and discuss in the hall the draft law on the management and use of weapons, explosives and supporting tools (amended). Previously, the Ministry of Public Security - the drafting agency - had reported on the expected direction of receiving and explaining the opinions of the National Assembly deputies' groups on the above draft law.

The draft law stipulates that high-damage knives are rudimentary weapons, except for knives used for daily life or production. During the discussion, some delegates requested clarification on whether the production of high-damage knives for work, production, and daily life is within the scope of this draft law, and whether it is subject to management. The Ministry of Public Security said that the draft law stipulates that high-damage knives are rudimentary weapons, so the production of high-damage knives is within the scope of this law. Organizations, enterprises, and individuals who produce, trade, export, and import high-damage knives on the list issued by the Minister of Public Security must declare information on the quantity, type of product, brand, and name of the manufacturing facility to the commune-level police. In particular, the use of high-damage knives for work, production, and daily life does not require declaration.
High-impact knives with blades 20 cm or longer
To distinguish it from ordinary knives, the draft defines "a highly lethal knife as a sharp knife, a pointed knife, or a sharp knife with a blade length of 20 cm or more, or a blade length of less than 20 cm but converted or assembled to have the same function and effect as a highly lethal knife...". There are opinions suggesting clarifying the scientific basis and basis for the regulation that a highly lethal knife has a blade length of 20 cm or more. Explaining this content, the Ministry of Public Security said that the regulation that a highly lethal knife has a blade length of 20 cm or more is based on the types of daggers equipped for armed forces to perform official duties (all of which are 20 cm or more in size). Along with that, many countries in the world such as Russia, Belarus, Australia... all regulate the size of the blade to ensure strict management. The practice of fighting crimes using knives to commit crimes also shows that most of the knives seized have blades of 20 cm or more. In addition, knives are dual-purpose tools commonly used by people every day in work, production, and daily life, and there are many different types. Therefore, the draft only adjusts knives with high lethality to effectively serve the work of preventing and fighting crime, but also does not affect or impact people's lives.

When is it a primitive weapon, when is it a military weapon?
Some opinions suggested clarifying the content of the regulation that highly lethal knives are primitive weapons; when primitive weapons are equipped and used to perform official duties or used for the purpose of illegally infringing on human life and health, they are military weapons. The Ministry of Public Security said that, through summarizing 5 years of implementing the Law on Management and Use of Weapons, Explosives and Supporting Tools in 2017, this agency found that, out of a total of 28,715 cases of illegal use of weapons, explosives and supporting tools, 88.4% of murder, robbery, intentional injury cases... used primitive weapons, knives and knife-like means to commit crimes. Particularly, subjects using knives and knife-like means accounted for 66.4% of these. Many cases of subjects using sharp, pointed knives with high lethality (chopping knives, cleavers, machetes, etc.) to kill people in a very reckless, cruel, and savage manner have caused public outrage. Although it is complicated, current regulations cannot handle subjects for the act of illegally storing and using weapons because knives are not considered weapons. To prevent, combat, and stop the above-mentioned crimes, the draft law clearly defines knives with high lethality as rudimentary weapons in the list issued by the Minister of Public Security. Rudimentary weapons equipped for performing official duties or not equipped but used for the purpose of illegally infringing on human life and health are military weapons. Knives with high lethality when used for the purpose of labor, production, and daily life (including family life, community life, ritual and religious activities) are not within the scope of this law.
