Ensure that local government operations are transferred to two levels without missing any tasks.

The Ministry of Home Affairs is amending the Law on Organization of Local Government to ensure that the transition from a 3-level to a 2-level government model takes place continuously, smoothly, without interruption or omission of tasks.

The Ministry of Home Affairs has just announced the draft Law on Organization of Local Government (amended) to comply with the requirements of converting the local government organization model from the current 3 levels (including: provincial level, district level and commune level) to 2 levels (including: provincial level and grassroots level).

Accordingly, the Draft Law on Organization of Local Government fundamentally and comprehensively amends the provisions of the current Law on Organization of Local Government, regulations on administrative units and organization and operation of local governments in administrative units.

The subjects of impact of the Law on Organization of Local Government (amended) are: All central state agencies (National Assembly, Government, ministries, ministerial-level agencies, agencies under the Government); Local governments at all levels, agencies, organizations, units under local governments and relevant people, enterprises, agencies, organizations, and individuals.

The Draft Law consists of 7 chapters and 49 articles, 1 article less than Law No. 65/2025/QH15, of which: 9 articles are kept, 3 articles are removed; 2 new articles are added; 35 articles are amended and supplemented.

In addition to inheriting the relevant provisions of the current Law on Organization of Local Government, the draft Law focuses on amending and supplementing the following 3 groups of issues: Amending regulations related to the organization of administrative units and the 2-level local government model; Amending regulations related to the division of tasks and powers of provincial and grassroots local governments and promoting decentralization and delegation between the Central and local governments and between provincial and grassroots local governments; resolving issues arising related to the conversion of the local government organization model from 3 levels to 2 levels.

To ensure that the operations of local governments when converting the government model from 3 levels to 2 levels take place continuously, smoothly, without interruption of work, without overlapping, duplication or omission of tasks, fields, areas, without affecting the tasks of socio-economic development, normal activities of society, people, businesses, ensuring national defense, security, social order and safety in the area, the draft Law stipulates transitional contents related to a number of important and urgent issues that need to be prioritized for resolution.

The draft stipulates that within 2 years from the effective date of the Law (from July 1, 2025), the Government shall issue legal documents under its authority to redefine the tasks and powers of local governments and adjust other regulations related to the implementation of tasks and powers of local governments for unified application during the period when laws, ordinances and resolutions of the National Assembly and the National Assembly Standing Committee have not been amended or supplemented, and periodically report to the National Assembly Standing Committee; in cases related to laws and resolutions of the National Assembly, it shall report to the National Assembly at the nearest session.

The draft also stipulates ending the organization of urban government models currently being implemented in Hanoi, Ho Chi Minh City, Da Nang City, Hai Phong City...

The Ministry of Home Affairs proposed to stipulate a deadline of 15 days for local government agencies at the district level to hand over work, records, documents, finances, budgets, headquarters, assets, and other related facilities to competent agencies, organizations, and units.

In addition, the draft also stipulates the continued implementation of works, investment projects, work, and the settlement of administrative procedures of district-level local authorities that have not been completed or have been completed but have arisen issues that need to be resolved; stipulates the assignment to the provincial People's Committee of the authority to change the order, procedures, and authority to perform the tasks and powers of provincial and grassroots local authorities.

In the draft Law on Organization of Local Government (amended), the draft also clearly states other relevant regulations to ensure continuous and normal operation of new agencies, organizations and units when implementing the 2-level local government model.
