The Chairman of Phuc Son Group has repeatedly given money to individuals from the Provincial People's Committee, the Department of Finance, and the Department of Natural Resources and Environment of Vinh Phuc province; colluded with the valuation company to create conditions to adjust the land value down to a low level.
According to the investigation conclusion, the Wholesale Market project was approved in 2012, initially invested by Song Hong Group Joint Stock Company, with a scale of 188 hectares, the total investment in the first phase was 2,290 billion VND.
But by the end of 2016, the investor had only implemented the 1/500 planning, and could not carry out the work for the first phase as approved, so the Vinh Phuc Provincial People's Committee put the project on the list of investment policy withdrawals.
At that time, Nguyen Van Hau (Chairman of the Board of Directors of Phuc Son Group) met with former leaders of Vinh Phuc province to negotiate the purchase of shares of Song Hong Group Joint Stock Company to continue implementing the project. Finally, although the company's documents did not meet the requirements, the Vinh Phuc Provincial People's Committee still decided to approve the project's investment policy, assigning Thang Long Company (Hau's company) as the investor.
Around June 2018, when it came time to calculate land use fees to fulfill financial obligations to the state, Nam Ha Company, with defendant Nguyen Ngoc Huy as director, was assigned to appraise the land. This company issued a certificate determining the value of land use rights for the 5.4-hectare commercial residential land lot of the project at more than VND708 billion.
Thinking that this valuation was too high, Hau "Phao" met with leaders of Vinh Phuc province to ask for influence and reduce the land valuation to a lower level.
Specifically, Nguyen Van Hau contacted and met Mr. Nguyen Van Khuoc (former Director of the Department of Natural Resources and Environment, Chairman of the Land Valuation Council of Vinh Phuc province) at Mr. Khuoc's office to discuss paying money to Mr. Khuoc and related individuals to facilitate the acceleration of land price determination and reduce part of the price for Thang Long Company when valuing land use fees at the Wholesale Market project.
Mr. Khuoc agreed and introduced Hau to meet Mr. Chu Quoc Hai (former Deputy Director of the Department of Natural Resources and Environment of Vinh Phuc) to reach an agreement. Hau met and was told by Mr. Hai: "You have been instructed by Mr. Khuoc, I am assured". Hau then continued to ask Mr. Khuoc to introduce him to meet Mr. Hoang Van Nhiem (former Deputy Director of the Department of Finance) so that Hau could discuss the creation of favorable conditions for land valuation and Mr. Nhiem agreed to support.
On October 2, 2018, the Department of Finance issued an invitation to the consulting unit to conduct a field survey. Nam Ha Company did not change the results of the land valuation certificate. Therefore, on November 28, 2018, the Vinh Phuc Provincial Land Valuation Council and the support team met and agreed to request Nam Ha Company to "investigate information to bring comparable assets with common prices in the market near the project to calculate the appropriate land price...".
To ensure pricing is beneficial to Thang Long Company, Hau directed his subordinates to contact and coordinate with Nam Ha Company to provide comparison samples.
According to Hau "Phao"'s testimony, after Nam Ha Company had the land valuation certificate, Hau continued to meet with Mr. and Mrs. Hoang Thuy Lan, Nguyen Van Khuoc, Chu Quoc Hai, Hoang Van Nhiem to discuss the high land valuation value, requesting a review and these individuals agreed to support and facilitate the review.
By December 2018, the Land Valuation Council approved the price of more than VND507 billion. After receiving the valuation certificate, Hau directed his subordinates to pay the money into the state budget.
The investigation agency determined that defendant Nguyen Van Hau had repeatedly given money (VND45.4 billion and USD2.32 million) to individuals from the Provincial People's Committee, the Department of Finance, and the Department of Natural Resources and Environment of Vinh Phuc province; colluded with the valuation company to create conditions to adjust the land value down to a low level.
