Decision No. 139-QD/TW takes effect from the date of signing and replaces Decision No. 173-QD/TW, dated July 8, 2008 of the Politburo (10th tenure) promulgating the Inspection Process of the Politburo and the Secretariat. The Decision clearly states that the Inspection Process of the Politburo and the Secretariat includes 3 steps: Preparation, implementation and completion.
The preparation step includes establishing an inspection team and developing an inspection plan. Accordingly, the Central Inspection Commission, based on the annual inspection program and plan; the direction of the Politburo and the Secretariat, presides over and coordinates with relevant agencies to advise on the development and issuance of decisions and inspection plans of the Politburo and the Secretariat, and outlines of reports on self-inspection results of the inspected subjects.
The Politburo and the Secretariat issue decisions and inspection plans. Based on the nature and content of the inspection, decide on the composition and number of members of the inspection team. Assign a Politburo member or a member of the Secretariat to be the head of the inspection team. The inspection period shall not exceed 180 days. If necessary, a decision may be made to extend the period but not more than 60 days. The inspection team shall plan the working schedule of the team, operating regulations, and assign tasks to each member of the inspection team; prepare relevant documents and materials, etc.
In the implementation step, the inspection team or the inspection team representative implements the decision and inspection plan, agrees on the working schedule with the inspected subject and the representative of the party organization managing the party member (if the inspected subject is a party member); requests the inspected subject to prepare a report according to the suggested outline, provide records and documents; directs the relevant organizations and individuals to coordinate the implementation. The inspected subject prepares a written self-inspection report and related records and documents to send to the Politburo or the Secretariat (through the inspection team).
After the Inspection Team has reviewed and verified, a conference will be held to approve the draft inspection results report (the Party organization that is the subject of the inspection or the direct manager of the inspected Party member will chair and record the minutes of the conference). At the same time, the Inspection Team will continue to review and verify unclear contents or those with different opinions; complete the draft inspection results report and submit it to the Politburo or the Secretariat (via the Central Inspection Committee).
The Politburo or the Secretariat assigns the Central Inspection Commission to synthesize the inspection results of the delegations and coordinate with the Central Party Office to send a draft report on inspection results to Politburo members or Secretariat members according to the Working Regulations.
In the final step, a meeting of the Politburo and the Secretariat will be held to review and draw conclusions. At the meeting, the Central Inspection Committee will report on the results of the inspections of the delegations, the opinions of the inspected subjects, and the proposals and recommendations of relevant organizations and individuals; the conference will discuss and draw conclusions.
In case the inspection subject concludes that the violation is serious enough to be considered, disciplined, and voluntarily self-criticizes and accepts the form of discipline, the Politburo or the Secretariat shall consider and decide or report to the Party Central Committee for consideration and decision according to its authority. In case the inspection subject is not self-conscious and does not accept responsibility, an inspection shall be conducted or the Central Inspection Committee shall be directed to conduct an inspection when there are signs of violation.
The inspection team completes the inspection results report, coordinates with the Central Party Office to draft the inspection conclusion notice and submits it to the Standing Secretariat for signing and promulgation.
The representative of the Politburo or the Secretariat shall notify or authorize the inspection team to notify the inspection conclusion to the inspected subject and relevant organizations and individuals for implementation.
The inspection team met to review experiences; completed the documents and handed them over to the Central Party Office for storage according to regulations.
The Central Inspection Commission is assigned to urge and supervise the inspected subjects to implement the inspection conclusions; periodically report to the Politburo and the Secretariat./.
