In 2024, construction order management (TTXD) in the province achieved many positive results. The number of violating constructions decreased to 1.71% (93/5,437 inspected constructions), significantly lower than the rate of 2.98% in 2023 and 4.8% in 2022. The whole province has issued 7,587 construction permits, an increase of 986 permits compared to the previous year. However, there are still some localities that are not active in inspection and handling of violations, especially some places that do not organize any construction inspections throughout the year.

Serious handling

According to the report of the People's Committees of districts, towns and cities, during the year, localities inspected 5,437 works, an increase of 1,208 works compared to 2023 (4,229 works) and 1,376 works compared to 2022 (4,061 works). Especially in Thanh Hoa City, Sam Son City, Bim Son Town, Nghi Son Town, the urban rules inspection team regularly coordinates with local authorities at ward and commune levels to organize inspections and perform the function of controlling construction order in areas under their management, so many works have been inspected and handled, such as: Thanh Hoa City inspected 1,992 works, Nghi Son Town inspected 1,446 works, Sam Son City inspected 646 works, Bim Son Town inspected 162 works.

A notable point in the handling of construction violations is that localities have issued 72 decisions to impose administrative penalties with a total amount of over 4.5 billion VND. Of which, Nghi Son town imposed the highest fine of nearly 1 billion VND from 16 violations. Thanh Hoa city imposed a fine of 450 million VND from 11 cases, Ngoc Lac district imposed a fine of 354 million VND from 11 cases.

One of the key factors contributing to the success of TTXD management is the synchronous participation of three parties: specialized management agencies, local authorities and interdisciplinary inspection teams. This model has created a tight monitoring network, in which each party promotes its strengths. This coordination is also demonstrated through the organization of regular and surprise inspections. Inspection teams not only focus on detecting and handling violations but also pay attention to prevention, promptly detecting and stopping signs of violations right from the beginning. This has significantly contributed to reducing the violation rate to 1.71%.

Innovation in management

To achieve the above results, in 2024, the Provincial People's Committee issued important directive documents such as Official Dispatch No. 4032/UBND-CN, dated March 26, 2024 on strengthening the management of construction planning, urban planning, and construction planning in the province and Official Dispatch No. 6831/UBND-CN, dated May 16, 2024 on strengthening inspection and examination of construction planning management according to decentralization in the province, creating a solid legal corridor for construction planning management.

In addition, the Department of Construction has promoted its leading role in proactively issuing documents urging the People's Committees of districts, towns and cities to strengthen inspection and handling of violations of planning and construction regulations in the areas under its management. At the same time, the Department has coordinated with the People's Committees of districts, towns and cities to organize 13 professional training courses on construction licensing, planning management and construction regulations management for officials and civil servants at district and commune levels. This is an important foundation to ensure uniform and professional law enforcement throughout the province.

Regarding construction licensing, in 2024, localities issued 7,587 licenses, an increase of 986 licenses compared to 2023. Some localities have had positive changes in construction licensing compared to previous years, such as: Thach Thanh District People's Committee issued only 7 construction licenses in 2022, only 8 construction licenses in 2023, but by 2024, 53 construction licenses were issued; Lang Chanh District People's Committee issued 42 construction licenses in 2022, 38 construction licenses in 2023, but by 2024, 81 construction licenses were issued.

One of the important highlights in the management of construction works is that each project is closely monitored from the commencement notification stage, through the construction stages, until completion and putting into use; not only helping to promptly detect and prevent violations but also creating favorable conditions for guiding and supporting investors to comply with regulations. In addition, clearly defining the responsibilities of leaders in the management of construction works has created an important change in the awareness and actions of leaders at all levels. Accordingly, the Chairman of the People's Committee at all levels must be directly responsible for the construction work situation in the area, which has promoted closer attention and direction for this work.

However, there is still a situation where people build houses without a permit; the number of construction commencement notices from investors is very low compared to the number of actual construction works; the number of works inspected in some localities is still low compared to the number of construction permits granted, such as: Hoang Hoa 4/119, Nga Son 12/431, Trieu Son 6/149, Nong Cong 1/67, Yen Dinh 2/397...; some localities do not even organize construction inspections, such as the districts of Thuong Xuan, Quan Hoa, Quan Son and Muong Lat; some localities detect violations but do not handle them thoroughly; there are also cases of administrative sanctions for non-compliance but the authorities have not taken resolute enforcement measures according to the law.

To continue promoting the achieved results and overcoming shortcomings in 2024, on January 9, 2025, the Provincial People's Committee issued Official Dispatch No. 405/UBND-CN on the implementation of construction management in the province in 2024; key tasks in 2025. Accordingly, the Provincial People's Committee requested localities to rectify and thoroughly overcome the shortcomings and limitations that have been pointed out, and at the same time strictly implement the directives of the Provincial People's Committee previously issued on construction management. In particular, units need to strengthen comprehensive supervision from the stage of construction commencement notification until the project is completed and put into use, with clear assignment of responsibilities and ensuring coverage of the management area. Along with that, the organization of regular and surprise inspections during the construction process is also given special attention, especially during the positioning and foundation construction stages to promptly detect and handle violations from the beginning.

The Provincial People's Committee also requested localities to seriously review their responsibilities for the shortcomings and limitations that have been pointed out. In particular, for cases of non-compliance with administrative sanction decisions, units must have a thorough enforcement plan, not allowing illegal construction to continue. The Provincial People's Committee also requested the Department of Construction to continue to enhance its role and responsibility in advising the Provincial People's Committee on construction management. At the same time, regularly inspect, monitor, guide and urge units to effectively implement directive documents, promptly report issues beyond their authority to the Chairman of the Provincial People's Committee.
