Many violations in the exploitation of landfill soil in Thua Thien Hue

On June 25, the People's Committee of Thua Thien Hue province announced that Chairman of the Provincial People's Committee Nguyen Van Phuong has just signed a document on strengthening land management and use for mineral exploitation projects in the province.

Accordingly, the People's Committee of Thua Thien Hue province requested the Department of Natural Resources and Environment to strengthen the dissemination and popularization of legal documents in the fields of land and minerals.

Guide and request organizations and individuals who have been licensed by competent authorities to carry out land and mineral procedures according to regulations, including carrying out land lease procedures in accordance with land law before organizing exploitation according to regulations.

"Strengthen inspection and examination of land management and use by organizations and individuals licensed by competent authorities to exploit minerals in order to promptly detect and strictly handle violations in accordance with authority and legal regulations.

Review expired mineral exploitation licenses to guide consideration of extension procedures in accordance with legal regulations; if the license is not extended, request to establish mine closure procedures and advise the Provincial People's Committee on land recovery procedures to hand over to the locality for management in accordance with regulations," the document clearly stated.

The People's Committee of Thua Thien Hue province also requested the People's Committees of districts, towns and Hue city to preside over and coordinate with relevant departments and branches to organize propaganda and dissemination of legal education in the field of land and minerals among local people.

Direct the People's Committees of communes, wards and towns and relevant departments to strengthen inspection, examination and close supervision of mineral exploitation activities of organizations and individuals in the area; promptly detect, prevent and strictly handle organizations and individuals with signs of violations such as: Exploitation outside the licensed scope and boundaries; mineral exploitation without completing land lease procedures, illegal mineral exploitation, without permission and other related violations according to regulations...

Previously, on June 10, 2024, the Inspectorate of Thua Thien Hue province issued the Conclusion of the inspection of licensing, management and exploitation of mineral deposits for filling materials (VLSL) in the province for the Department of Natural Resources and Environment, Department of Agriculture and Rural Development, mineral exploitation units and related organizations and individuals.

The inspection period is from 2017 to 2022, including units licensed to exploit from 2017 to 2022 and units licensed before 2017 but still exploiting in the period from 2017 to 2022.

Notably, in addition to coordinating to remove obstacles, speeding up the licensing process for land leveling mining to promptly solve the need for land leveling to serve key projects and works in the province.

The inspection conclusion also pointed out many shortcomings and violations of the Department of Natural Resources and Environment, the Department of Agriculture and Rural Development, the Provincial Economic - Industrial Zone Management Board, and mineral exploitation units in granting technical licenses, exploitation activities, implementing regulations on land, environmental protection, mine closure, changing forest use purposes, and fulfilling financial obligations.

Based on the report and proposal of the inspection team, the Provincial Inspectorate issued 19 decisions on the recovery of more than VND 4.5 billion paid to the state budget by units that declared and paid insufficient natural resource tax and environmental protection fees; and the collection of the value of mineral land used for mining activities for the output exceeding the license.

At the same time, it is recommended that the Chairman of the Provincial People's Committee direct the Department of Natural Resources and Environment, the Department of Agriculture and Rural Development, the Provincial Economic - Industrial Zone Management Board, and mineral exploitation units to seriously implement the inspection conclusion of the Provincial Inspector.

19 mines have violated the under-declaration of production

Regarding the implementation of financial obligations, according to the inspection conclusion, 19/28 mines violated the law by under-declaring output; incorrectly declaring tax rates, unit prices for calculating resource tax, coefficients for calculating environmental protection fees according to the open-pit mining method; mining output was larger than the granted business registration certificate, leading to the need to collect and pay to the state budget more than 4.5 billion VND.

Of which, 15/28 mines under-declared resource tax with an amount of more than 2 billion VND; 16/28 mines under-declared environmental protection fees with an amount of more than 1.1 billion VND; 4/28 mines exploited a larger output than the granted business license, leading to the need to collect the value of minerals obtained for the output greater than the license by an amount of more than 1.3 billion VND.
