Many tourist ports in Khanh Hoa await instructions on land lease extension

On February 26, Khanh Hoa Department of Natural Resources and Environment said it had sent a document to the Ministry of Natural Resources and Environment requesting professional guidance related to planning and land use plans for alluvial land along rivers, coastal land, land with coastal water surface in provincial planning, provincial land use plans...

The reason is that in the process of consulting on planning and land use plans, this department found problems and could not extend land leases for some inland waterway ports serving tourism.

Encountering difficulties in extending the lease of inland waterway land

Specifically, in Article 3 of Circular No. 02/2015 of the Ministry of Natural Resources and Environment detailing a number of articles in Decrees No. 43 and 44 of the Government, riverside alluvial land, coastal alluvial land, and land with coastal water surface must be shown in provincial planning, provincial and district land use plans...

However, in Circular No. 01/2021 of the Ministry of Natural Resources and Environment regulating the technical aspects of establishing and adjusting land use planning and plans, alluvial land along rivers, coastal areas, and coastal water surface land are not specified in the land use indicator system as well as the appendix of the system of forms and templates for establishing and adjusting land use planning and plans.

Therefore, Khanh Hoa Department of Natural Resources and Environment has no basis to guide localities in implementing land use planning and plans for the above land types according to regulations.

Currently, some businesses are having difficulty renting land with sea frontage, because there are no instructions from the Ministry of Natural Resources and Environment.

Long Phu Tourism Joint Stock Company is still waiting for instructions on procedures to lease land with sea surface at Hoa Lan and Hon Lao islands to invest and operate inland waterway ports in accordance with regulations.

Similarly, Phat Dat Company Limited has now expired its license to operate the My Canh - Tan Thanh inland waterway port and is waiting for instructions on renewal procedures.

Extension of land use pending instructions from the ministry

It is known that among the inland waterway ports whose licenses have expired and are awaiting instructions from the Ministry of Natural Resources and Environment, Khanh Hoa province has only agreed to extend the land use of Thanh Van - Tan Thanh inland waterway port and extend the land use until December 31, 2024.

According to this province, the extension of land use at Thanh Van - Tan Thanh wharf is to ensure the maintenance of passenger pick-up and drop-off activities to serve the business needs of L'alya resort of Thanh Van Eco-tourism Joint Stock Company (while waiting for guidance from the Ministry of Natural Resources and Environment on planning and land use plans for riverside alluvial land, coastal alluvial land...).

Khanh Hoa province assigned departments and branches to guide investors to complete procedures for extending land use and operating inland waterway ports in accordance with legal regulations; continue to review legal regulations to synthesize and seek guidance from the Ministry of Natural Resources and Environment on the above-mentioned issues.

The province assigned the People's Committee of Ninh Hoa town to study and update the above-mentioned inland waterway port into the adjustment of the town's land use planning until 2030, to carry out land procedures in accordance with regulations.
