On the afternoon of November 7, the People's Court of Yen Bai province announced the verdict for the defendants in the trial of the case of Violating regulations on resource exploitation and Illegal use of explosives, which occurred in Yen Binh district (Yen Bai).
Accordingly, the first-instance trial panel completely rejected the accusations of the People's Procuracy of Yen Bai province against defendant Dinh Tien Hung, former Deputy Secretary of the Yen Bai Provincial Youth Union.
The presiding judge, Judge Nguyen Trung Dung, declared Mr. Dinh Tien Hung not guilty.
The other 9 defendants received the following sentences:
Lang Duc Han, Director of Ngoc Tam Trading Company Limited, 19 years in prison, fined 100 million VND.
Nguyen Van Hau, Director of Tuyen Huy Company Limited, 18 years in prison, fined 100 million VND.
Bui Minh Duc, worker at Ngoc Tam Trading Company Limited, 17 years and 6 months in prison, fined 50 million VND.
Bui Manh Hung, Deputy Director of Tuyen Huy Company Limited, 17 years in prison, fined 50 million VND.
Nguyen Van Bau, security guard of Ngoc Tam Trading Company Limited, 15 years in prison.
Nguyen Trong Tuan, Deputy Director of Tuyen Huy Company Limited, 14 years in prison, fined 50 million VND.
Tran Dac Viet, explosives warehouse keeper of Ngoc Tam Trading Company Ltd., 10 years in prison.
The defendants Luu Bang Doan and Nguyen Manh Hung, freelance workers, were both sentenced to two years in prison with suspended sentences.
Previously, during the investigation and prosecution process, Mr. Dinh Tien Hung, former Deputy Secretary of Yen Bai Provincial Youth Union, was accused of violating regulations on resource exploitation, acting as the initiator, raising the issue and providing the level of profit for himself as well as for Tuyen Huy Company in illegal mineral exploitation, with a prosecution penalty of 2 to 7 years in prison.
At the trial, Mr. Dinh Tien Hung said that from the time he was prosecuted until the police concluded their investigation, the defendant continuously sent petitions of injustice from the local level to the central level requesting clarification, but did not receive a satisfactory explanation.
The case progressed as follows: On December 30, 2020, Yen Bai Provincial Police caught Bui Minh Duc red-handed for illegally transporting explosives, seizing 294kg of explosives and 400 detonators on the spot.
Expanding the investigation, Yen Bai Provincial Police determined that Lang Duc Han, Director of Ngoc Tam Trading Company Limited, and his accomplices used nearly 3 tons of explosives to illegally mine lead and zinc ore in existing tunnels at Nui Ngang mine with a total volume of more than 1,000 tons, appropriating over 2 billion VND.
After that, Yen Bai Provincial Police initiated a case, issued an arrest warrant for 9 defendants for the crimes of Illegally transporting and using explosives and Violating regulations on resource exploitation, to be handled according to the provisions of law.
On April 5, 2022, Yen Bai Provincial Police issued a decision to prosecute and order Dinh Tien Hung (born in 1984, residing in Group 10, Dong Tam Ward, Yen Bai City) to be banned from leaving his place of residence for the crime of Violating regulations on resource exploitation.
The case has lasted nearly 3 years since its inception. The case file has been transferred and returned many times by the prosecution agencies, prolonging the time.
