Pursuant to the Law on Organization of Local Government dated June 19, 2015; Law amending and supplementing a number of articles of the Law on Organization of the Government and the Law on Organization of Local Government dated November 22, 2019;
Pursuant to the Law on Promulgation of Legal Documents dated June 22, 2015; Law on amending and supplementing a number of articles of the Law on Promulgation of Legal Documents dated June 18, 2020;
Pursuant to the State Budget Law dated June 25, 2015;
Pursuant to Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system;
Pursuant to Circular No. 01/2025/TT-BNV dated January 17, 2025 of the Ministry of Home Affairs guiding the implementation of policies and regimes for cadres, civil servants, public employees and employees in the implementation of organizational arrangement of the political system;
Pursuant to Circular No. 07/2025/TT-BTC dated January 24, 2025 of the Ministry of Finance guiding the determination of funding sources and the preparation of estimates, management, use and settlement of funding for implementing policies prescribed in Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in implementing the organizational arrangement of the political system,
Considering Submission No. 16/TTr-UBND dated February 18, 2025 of the Provincial People's Committee on the proposal to issue a Resolution regulating additional support policies for cadres, civil servants, public employees, and workers in the implementation of organizational restructuring under the management scope of Nam Dinh province; Verification report of the Legal Committee of the Provincial People's Council and discussion opinions of the Provincial People's Council delegates at the session.
RESOLUTION:
Article 1. Regulations on additional support policies for cadres, civil servants, public employees and workers in the implementation of organizational restructuring under the management scope of Nam Dinh province.
1. Scope of adjustment:
Resolution stipulating additional support policies for cadres, civil servants, public employees receiving salaries from the state budget, people working under labor contracts in agencies, organizations, units of the Party, State, Vietnam Fatherland Front, socio-political organizations at provincial and district levels who retire (retire early and resign) during the implementation of organizational restructuring under the management of Nam Dinh province, including:
a) Agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations at the provincial and district levels;
b) Public service units whose regular expenditures are guaranteed by the State budget and public service units that partially self-guarantee regular expenditures belong to the Provincial People's Committee, specialized agencies under the Provincial People's Committee, under the District People's Committee and other public service units according to the provisions of law.
2. Applicable subjects: Cadres, civil servants, public employees receiving salaries from the State budget, people working under labor contracts in agencies, organizations, units of the Party, State, Vietnam Fatherland Front, socio-political organizations from provincial to district levels in the implementation of organizational restructuring under the management of Nam Dinh province, who retire and enjoy the regimes and policies according to Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government on policies and regimes for cadres, civil servants, public employees, workers and armed forces in the implementation of organizational restructuring of the political system, including:
a) Cadres, civil servants and public employees receiving salaries from the State budget;
b) People working under labor contracts as prescribed by labor law before January 15, 2019 in administrative agencies, organizations and public service units whose regular expenses are guaranteed by the State budget and public service units that partially self-guarantee regular expenses (hereinafter referred to as employees).
3. Support policy
In addition to the Government's policies and regimes for cadres, civil servants, public employees and workers in the implementation of the organizational arrangement of the political system; Nam Dinh province provides one-time additional support for the subjects specified in Clause 2, Article 1 of this Resolution who retire (retire early and quit their jobs) equal to 30% of the allowance that the retiree is entitled to according to the provisions of Clause 1, Article 7, Clause 1, Article 9 and Clause 1, Article 10 of Decree No. 178/2024/ND-CP dated December 31, 2024 of the Government.
4. If the subjects specified in Clause 2, Article 1 of this Resolution are re-employed in agencies, organizations and units receiving salaries from the State budget within 60 months from the date of implementation of the work according to the decision of the competent authority, they must return the support amount they have received. The re-hiring agency, organization or unit is responsible for recovering the entire amount of support and paying it to the State budget according to regulations.
5. Funding sources for policy implementation
a) For cadres, civil servants and employees in agencies of the Communist Party of Vietnam, the State, the Vietnam Fatherland Front, and socio-political organizations at the provincial and district levels: Funding for policy settlement is provided by the provincial budget.
b) For civil servants receiving salaries from the State budget and employees in public service units whose regular expenditures are guaranteed by the State budget: Funding for policy settlement is provided by the provincial budget.
c) For civil servants receiving salaries from the State budget and employees in public service units that partially self-insure regular expenses: Funding for policy settlement comes from the unit's revenue from public service activities, State budget allocations and other legal sources. The provincial budget will allocate funding for policy settlement based on the number of employees receiving salaries from the State budget assigned by competent authorities.
Article 2. The Provincial People's Committee is assigned to organize the implementation of the Resolution.
Article 3. The Standing Committee of the People's Council, the People's Council Committees, the People's Council Delegation Groups and the Provincial People's Council delegates supervise the implementation of the Resolution.
This Resolution was passed by the 19th Nam Dinh Provincial People's Council, 24th Session on February 19, 2025 and takes effect from February 19, 2025./.
