Therefore, the completion of regulations on planning, standards... for public services is extremely urgent.
On this basis, the decentralized agencies in handling administrative procedures eliminate regulations requiring consultation, approval or opinions from superiors on issues that have standards, conditions, processes, or have been decentralized or delegated.
Mr. Long emphasized the need to comprehensively amend the Law on Government Organization and the Law on Local Government Organization, especially to perfect regulations on the tasks and powers of government levels. Clearly defining the principles of decentralization and delegation of power will help to clearly define the tasks of each level, creating a legal basis for implementation.
According to the Deputy Minister of Home Affairs, the current regulations on the Prime Minister's authority in decentralization and delegation of power lack consistency, creating inadequacies, such as the situation where "many small matters must be submitted to the Prime Minister". "This is the basis for ministries and branches to review and propose amendments to specialized laws to implement the Government's policy of promoting decentralization and delegation of power, meeting the requirements of modern and effective national governance", said Deputy Minister Long.
To remove bottlenecks and promote economic development, he suggested that the Ministry of Planning and Investment and the Ministry of Finance amend laws in the fields of planning, investment, and finance to handle urgent and complicated issues related to decentralization and delegation of power.
To ensure systematicity and scientificity, agencies need to adhere to the principle of separating regulations and not incorporating issues of organizational structure and staffing into other legal documents. Giving the Government the authority to assign specific tasks to ministries and branches will create conditions for the Government to flexibly adjust to suit the actual situation.
In addition, Mr. Long also proposed solutions to improve regulations on organizational structure, adjust the number of appropriate staff to effectively implement decentralization and delegation of authority. The mechanism to control power, ensure authority goes hand in hand with responsibility, especially accountability when performing decentralized tasks.
Minister and Head of the Government Office Tran Van Son said that in 2022, the Prime Minister requested ministries to decentralize 699 administrative procedures in legal documents, decrees, and circulars. After 2 years of implementation, about 299 administrative procedures have been decentralized in 56 legal documents, reaching 43.8%. Currently, there are more than 400 administrative procedures that need to be decentralized, which will be implemented this year and next year.
At the Government meeting this morning, October 7, Prime Minister Pham Minh Chinh also emphasized the spirit of strong decentralization and delegation of power as required by the 10th Central Conference, which is "locality decides, locality acts, locality takes responsibility". "There is no reason why we do not decentralize and delegate power, there is no reason why we do not eliminate the request-grant mechanism. There may be problems and conflicts during the implementation process, but we will continue to resolve them," said the Prime Minister.
The policy of promoting decentralization and delegation of power has been mentioned many times by the Prime Minister. In September, at a Government meeting on law-making, the Prime Minister requested to "avoid the situation where subordinates ask superiors for any matter and wait for the Central Government to decide".
