Decentralize approval authority from the Prime Minister to the Provincial People's Committee for plans that specify provincial plans and general plans of centrally-run cities.
On October 25, Chairman of the National Assembly's Economic Committee Vu Hong Thanh presented a report explaining, accepting and revising the draft Law on Urban and Rural Planning (QHĐTNT).
Regarding consultation on planning tasks, according to Mr. Thanh, the draft Law has been revised in the direction of redesigning Articles 35 and 36, distinguishing between consultation on planning tasks and consultation on urban and rural planning in terms of responsibilities, subjects, content, form, and time for consultation.
Accordingly, only community opinions are collected for the National Urban Planning. The order and procedures for collecting community opinions are implemented according to legal regulations on democracy; the agency organizing the National Urban Planning is responsible for synthesizing, receiving, and explaining community opinions and must publicly announce and ensure democratic regulations.
Regarding the scope of the subjects for consultation, Mr. Thanh informed that this issue is clearly defined in the QHĐTNT task. To shorten the time for organizing the planning task and planning, the consultation time has been adjusted. For the planning task, the agencies are required to give their opinions within 7 days from the date of receiving the complete dossier.
For the QHĐTNT, agencies, organizations and experts are required to give their opinions within 15 days from the date of receiving complete documents, and the community to give their opinions within 30 days, ensuring that it is consistent with the nature, requirements and purpose of the consultation.
In addition, the draft Law has moved the provision in Article 40 on consulting the Ministry of Construction and the opinions of specialized agencies on urban planning to Article 36 and revised it to clarify the content, legal value and time limit for comments from these agencies and to be consistent with the practice of urban planning in our country.
Also according to Mr. Thanh, regarding the authority to approve planning tasks and urban and rural planning; the authority to approve adjustments to urban and rural planning, and to absorb opinions, the draft Law is revised in the direction of continuing to decentralize the approval authority from the Prime Minister to the Provincial People's Committee for plans that specify provincial planning and general planning of centrally-run cities approved by the Prime Minister to enhance the role, initiative and responsibility of local authorities.
In addition, clarify the authority of the Prime Minister to approve the master plan, zoning plan, and detailed plan of areas of national significance in terms of politics, culture, history, security, and defense as determined in the national master plan, regional master plan, and master plan of centrally-run cities.
At the same time, it is supplemented with regulations for urban planning under the approval authority of the provincial People's Committee but established by the district People's Committee. The district People's Committee shall organize the establishment, appraisal, approval, and announcement of local adjustments to the planning according to the order and procedures prescribed by the provincial People's Committee.
The Draft Law continues to stipulate the authority of the Prime Minister to approve planning tasks and general planning of provincial cities that are type I urban areas, in accordance with the location, function, and role of type I urban areas that need to be strictly controlled in terms of space.
