Prosecution and temporary detention of the commander of the hydroelectric tunnel construction site where 3 workers died

On July 16, the Investigation Police Agency of Lai Chau Province Police issued a decision to prosecute and issue an arrest warrant for Le Van Duan, commander of the Nam Cuoi 1 hydropower tunnel construction site (Nam Hang commune, Nam Nhun district, Lai Chau province).

As reported by SGGP Newspaper, this project is a water tunnel of the Nam Cuoi 1 hydropower project invested by Nam Cuoi 1 Joint Stock Company, the construction unit is T&D 86 Company Limited. During the construction process, an incident occurred in which 3 workers died.

Based on the initial investigation results, on July 13, the Investigation Police Agency of Lai Chau Provincial Police decided to initiate a case to conduct an investigation according to the law.

After collecting documents and evidence, the authorities determined: Le Van Duan (born in 1986, residing in Vinh Hung commune, Vinh Loc district, Thanh Hoa province) is currently residing at the Nam Cuoi 1 hydropower construction site, and was appointed by the Director of T&D 86 Company Limited as the commander of the construction of the Nam Cuoi 1 hydropower tunnel from February 2023.

During the construction process, Le Van Duan committed many violations in implementing regulations on ensuring labor safety in the tunnel, resulting in 3 workers of the company, VTS (wheel loader operator), TATr. and PLU (electrical and water workers) suffering from suffocation, acute respiratory failure, circulatory collapse and death.

On July 16, the Investigation Police Agency of Lai Chau Provincial Police decided to prosecute and issue an arrest warrant for Le Van Duan for the crime of "Violating regulations on labor safety" as prescribed in Clause 3, Article 295 of the Penal Code.

After being approved by the Lai Chau Provincial People's Procuracy, on the same day, the Office of the Investigation Police Agency of Lai Chau Provincial Police executed the above decisions and prosecution orders.
