(GLO)- From July 1, the Government issued Decree 39/2023/ND-CP detailing a number of articles of Resolution No. 73/2022/QH15 dated November 15, 2022 of the National Assembly on pilot auction of car license plates. According to the Decree, the list of car license plates to be auctioned must be made public at least 30 days before the auction date.
Decree 39/2023/ND-CP clearly states that auction participants are Vietnamese organizations and individuals who are eligible to participate in car license plate auctions according to the provisions of this Decree and other relevant legal provisions. Car license plate auctions are conducted online in the network environment and must comply with the provisions of the law on property auctions and network security.
The Minister of Public Security decides on the number of car license plates to be auctioned at each auction, including car license plates of provinces and centrally run cities, serial numbers: A, B, C, D, E, F, G, H, K, L, M, N, P, S, T, U, V, X, Y, Z with white background, black letters and numbers that have not been registered, are expected to be newly issued, and are in the Vehicle Registration and Management System of the Ministry of Public Security, and supplements the number of car license plates for the Public Security of provinces and centrally run cities in case there are no more car license plates to register before the next auction.

The Ministry of Public Security shall transfer the list of car license plates to be auctioned to the property auction organization, and at the same time publicly announce the list and the plan for organizing the auction of car license plates on the Ministry of Public Security's electronic information portal, the Traffic Police Department's electronic information portal, with a link to the property auction organization's online auction information page.
The property auction organization shall publicly announce the list of license plates of cars put up for auction on the national property auction information portal, the property auction organization's online auction information page and post it at its headquarters. The auction regulations must be posted and publicly announced on the online auction information page and the property auction organization's headquarters.
According to the Decree, the time for public announcement, posting, auction regulations, and list of car license plates to be auctioned must be at least 30 days before the auction date.
Conditions for registration to participate in the auction include: Belonging to the above-mentioned auction participants and paying a deposit to the property auction organization according to the provisions of Clause 2, Article 3 of Resolution No. 73/2022/QH15; Organizations and individuals registering to participate in the auction are responsible for the accuracy and honesty of the information declaration to register to participate in the auction.
The Decree also stipulates the deposit for participation in auctions. Specifically, the deposit is deposited into a separate payment account of the property auction organization opened at a bank from the time of registration to 3 days before the auction. In case of winning the auction, the deposit is transferred to the specialized collection account of the Ministry of Public Security to be paid into the state budget according to regulations.
Within 7 working days from the date of receiving the auction results, auction minutes, and list of auction winners from the property auction organization, the Ministry of Public Security shall issue a document approving the auction results.
The Ministry of Public Security shall send a notice of the winning auction results for car license plates to the email address and a notification message to the phone number registered in the access account for the auction winner immediately after approving the auction results; the notice of the winning auction results for car license plates replaces the contract for the sale of auctioned assets or the contract for the sale of state assets.
According to the Decree, the content of the announcement of the auction results includes: the license plate number of the auctioned car, the name and identification code of the individual or organization (in case the organization has not been granted an identification code, the tax code or the number of the decision to establish the organization must be recorded), the address of the auction winner, the auction price, the amount to be paid, the number of the specialized collection account opened by the Ministry of Public Security at a bank or foreign bank branch to pay the auction winning money, the deadline for paying the auction winning money, and the cancellation of the auction results if the full auction winning money is not paid according to regulations.
Within 15 days from the date of announcement of auction results, the auction winner must pay the entire auction winning amount after deducting the deposit amount into the Ministry of Public Security's specialized collection account opened at a bank or foreign bank branch. The auction winning amount does not include vehicle registration fees.
Immediately after receiving the full amount of the auction, the Ministry of Public Security shall issue an electronic invoice for the sale of public assets and an electronic document confirming the license plate number of the auctioned car sent to the auction winner's email address to complete the vehicle registration procedures. The pilot auction of car license plates prescribed in this Decree shall be implemented from July 1, 2023 to July 1, 2026.
