(NLDO) – Two former chairmen of the People's Committee of Binh Thuan province were accused of violations related to land allocation at the Bien Que Huong project with an area of 12.5 hectares.
On January 26, the Ministry of Public Security's Investigation Police Agency announced that it had just issued a decision related to checking and verifying information about crimes related to the Que Huong Sea Community Tourism Project (Thuan Quy Commune, Ham Thuan Nam District, Binh Thuan Province).
Previously, a number of citizens residing in Phan Thiet City and Duc Linh District, Binh Thuan Province denounced Mr. Le Tuan Phong - former Chairman, Mr. Nguyen Ngoc Hai - former Chairman of Binh Thuan Provincial People's Committee and a number of individuals at relevant departments and branches, for "Violating regulations on land management; Violating regulations on management and use of state assets causing loss and waste; Abusing positions and powers while performing official duties" when approving financial plans, deciding to allocate and lease land to implement the Que Huong Sea Community Tourism Project.
The Ministry of Public Security's Investigation Police Agency inspected and verified the source of information about the crime and determined that the above accusations were baseless, and that the acts of approving financial plans and land allocation and leasing decisions by Mr. Le Tuan Phong and Mr. Nguyen Ngoc Hai did not constitute a crime.
On that basis, the Ministry of Public Security's Investigation Police Agency decided not to prosecute the criminal case against the source of information about the crime according to the denunciation at the Que Huong Sea Community Tourism Project.
The decision not to prosecute the case is forwarded to the Supreme People's Procuracy and the individuals who filed the complaint.
Previously, the Bien Que Huong Community Tourism Service Area project was among nine projects that the Ministry of Public Security was investigating in Binh Thuan to clarify violations in the management and use of state assets causing loss and waste.
The project of Bien Que Huong Community Tourism Service Area was allocated land and leased land by the People's Committee of Binh Thuan province in Decision No. 2590/QD-UBND dated September 27, 2018, adjusted in Decision No. 1074/QD-UBND dated May 2, 2019 with an area of over 12.5 hectares. Of which, more than 104,000 m2 is located in Thuan Quy commune (Ham Thuan Nam district) and more than 20,600 m2 of land belongs to Tien Thanh commune (Phan Thiet city).
According to the People's Committee of Binh Thuan province, for the land belonging to Phan Thiet city, the project invested by Vietnam Logistics and Chemicals Joint Stock Company (formerly) only builds works for public purposes, not for business purposes, so it falls under the case of the State allocating land without collecting land use fees according to the provisions of Clause 2, Article 54 of the 2013 Land Law, and falls under the case of not auctioning land use rights at Point a, Clause 2, Article 118 of the 2013 Land Law.
As for the project land located in Ham Thuan Nam district, which is an investment incentive area, it is exempted from land rent for 7 years according to Clause 3, Article 19, Decree No. 46/2014/ND-CP of 2014 of the Government, so it is not subject to the case of not auctioning land use rights at Point b, Clause 2, Article 118 of the 2013 Land Law. Regarding this land allocation, citizens in Binh Thuan have filed a complaint clarifying the basis for land allocation without auction.
