According to the proposal of Hanoi City, there are 107 traffic violations proposed to increase the fine by 1.5-2 times compared to Decree 168/2024. Accordingly, the act of driving a car not on the right side of the direction of travel; driving in the wrong part of the road or lane (lane in the same direction or lane in the opposite direction) is proposed to be fined 8-12 million VND, double the current regulation; the act of driving a car on the road with a blood or breath alcohol concentration exceeding 80 mg/100 ml of blood or exceeding 0.4 mg/liter of breath is proposed to be fined 45-60 million VND, 1.5 times the current regulation.

Regarding the necessity of issuing this decree, Hanoi City said that the Capital Law 2024 assigns the City People's Council to prescribe a fine level higher than, but not more than twice, the general fine level prescribed by the Government and not exceeding the maximum fine level prescribed by law on handling administrative violations for a number of corresponding administrative violations in the field of road traffic.

In addition, Hanoi City believes that law enforcement, especially in handling administrative violations in the field of road traffic, the city still applies the same as other localities. "It is necessary to have regulations and sanctions that are specific to the capital city" - the draft stated.

According to the draft Resolution, the awareness of traffic participants in recent times has been limited, participating in traffic based on subjective awareness such as low awareness, lack of self-awareness, as well as poor understanding of traffic laws.

In addition, the situation of violators still continues to repeat certain violations such as not complying with road markings, traffic signs, not wearing helmets, going the wrong way, entering prohibited roads, driving in the wrong lane, not obeying traffic lights, stopping and parking in violation of regulations... Due to the diversity of traffic participants and the lack of fixed residence affecting the dissemination and education of road traffic laws, it is necessary to improve solutions for handling violations to raise awareness of law compliance among traffic participants.

According to the Hanoi People's Committee, the rate of increase in means of transport in the city year after year is about 2-4%; the total number of newly registered vehicles each year has decreased but is still high. In addition, traffic congestion still occurs during rush hours (morning and afternoon), especially on radial routes and main routes in and out of the city; the expansion of routes and the promotion of the passenger transport system have not yet met the travel needs of the people, mainly personal vehicles are still involved in traffic.

In addition to subjective causes, Hanoi City believes that some traffic congestions are caused by traffic participants violating rules such as avoiding overtaking, not giving priority, stopping and parking in violation of regulations... The situation of teenagers gathering to drive and causing public disorder has many complicated developments, affecting the situation of order and traffic safety and causing insecurity for people and traffic participants in areas where this situation occurs.

According to the Hanoi People's Committee, on December 26, 2024, the Government issued Decree No. 168/2024/ND-CP regulating administrative sanctions for violations of traffic order and safety in the field of road traffic such as deduction of points, restoration of driving license points... Although the penalties for some violations have been increased, the draft Resolution of the Hanoi People's Committee stated that, based on the city's reality and the situation of violations of traffic order and safety, it is necessary to continue to impose heavier penalties for some violations to raise people's awareness of voluntary compliance when participating in traffic. This is aimed at gradually forming a traffic culture in the city, curbing and reducing traffic congestion and traffic accidents.
