Removing land price obstacles but still ensuring to avoid budget loss

Reporting at the meeting, Mr. Doan Ngoc Phuong, Deputy Director of the Department of Land Resources Development Planning (Ministry of Natural Resources and Environment), said that Decree No. 44/2014/ND-CP dated May 15, 2014 of the Government (Decree 44) regulating land prices has 4 chapters and 24 articles. In which, there are regulations on 5 methods of land valuation, including: direct comparison, deduction, income, surplus, land price adjustment coefficient and conditions for applying these 5 methods.

The Ministry of Natural Resources and Environment is reviewing, amending and supplementing regulations on land prices when drafting a Decree to replace Decree 44.

Following the Government's direction on amending Decree 44, the Ministry of Natural Resources and Environment has coordinated with a number of localities, universities, and relevant units to draft the decree.

Notable amendments and supplements are on land valuation methods; application of land valuation methods; information for applying land valuation methods; procedures and contents for determining land prices by the comparison method; procedures and contents for determining land prices by the income method; procedures and contents for determining land prices by the land price adjustment coefficient method; determining specific land prices; procedures and procedures for determining specific land prices; preparation for land valuation, selection of organizations with the function of consulting on determining specific land prices; determining specific land prices by the land price adjustment coefficient method.

At the meeting, many opinions said that it is necessary to amend the definition of "common land price on the market" (Clause 3, Article 3 of Decree 44); clarify the procedures and methods of land valuation for each land valuation method...

There will be a number of in-depth workshops to gather opinions from the Department of Natural Resources and Environment as well as relevant agencies, valuation companies... to amend Decree 44.

Deputy Minister Le Minh Ngan requested the Department of Land Resources Planning and Development to study and absorb the opinions of delegates to soon complete the draft to collect opinions from organizations and individuals.

At the same time, to ensure the quality of the draft decree, Deputy Minister Ngan directed the Department of Planning and Land Resources Development to plan to organize in-depth workshops in a number of localities to collect opinions from the Department of Natural Resources and Environment as well as related departments, branches, valuation companies, etc.

The leaders of the Ministry of Natural Resources and Environment noted that the amendment of the decree, especially the contents related to land price determination, needs to ensure proper implementation of legal provisions, remove difficulties and obstacles, ensure publicity, transparency, ease of application, especially uniform application nationwide and avoid loss of revenue to the state budget.

Previously, on June 9, the Ministry of Natural Resources and Environment posted a request for comments on the draft Circular amending and supplementing a number of articles of Circular No. 36/2014/TT-BTNMT dated June 30, 2014 of the Ministry of Natural Resources and Environment (Circular 36) detailing land valuation methods; developing and adjusting land price lists; specific land valuation and consulting on land price determination.

In particular, the Ministry of Natural Resources and Environment has proposed to amend and supplement the direct comparison method, income method, and surplus method; at the same time, it also proposed to remove the land price option in Article 31 of Circular 36 regulating the appraisal of land price options.
