The National Assembly has issued a resolution on specific mechanisms and policies to remove difficulties and obstacles for projects and land in the inspection, examination and judgment conclusions in Ho Chi Minh City and a number of provinces and cities, helping a series of "giant" projects have a chance to revive.

The National Assembly's Resolution on specific mechanisms and policies to remove difficulties and obstacles for projects and land in inspection, examination and judgment conclusions in Ho Chi Minh City, Da Nang and Khanh Hoa will take effect from April 1, 2025.
For Ho Chi Minh City, the resolution has removed difficulties for projects of up to tens of hectares in Thu Duc City and District 4, including projects that have been handed over but also projects that have been stalled for many years.
Series of real estate projects in Thu Duc are cleared
Regarding the handling of land prices, land use fees and land rents for projects in Ho Chi Minh City in the inspection results report No. 332/BC-TTCP dated December 9, 2020 of the Government Inspectorate (referred to as report 332), Resolution 170 removes obstacles in land valuation for projects.
In particular, Resolution 170 stipulates that the specific time for determining land prices to calculate land use fees for the 1,330-apartment project in Report 332 is determined on the principle that "for the land area equivalent to the land use fees that the investor has temporarily paid to the state agency, the time for determining land prices is the time of contract liquidation with the investor (March 30, 2018)".
For the land area for which land use fees have not been paid, the resolution stipulates that the time for determining land prices is the time when the competent state agency issues a land allocation decision (December 11, 2020).

According to Tuoi Tre Online's research, the investment project to build 1,330 apartments (commercial name is New City) is located on a 38.4ha land plot in Binh Khanh ward (Thu Thiem new urban area, Thu Duc city), with a frontage on Mai Chi Tho street. The project is invested by a consortium of Saigon Real Estate Joint Stock Company (TTC Land) - Thuan Viet Construction and Trade Company Limited - Thanh Thanh Cong Production and Trade Joint Stock Company.
The apartments at New City apartment building are among more than 5,600 surplus apartments that the Ho Chi Minh City People's Committee no longer needs to use to resettle people being evicted in the new urban area of Thu Thiem.
Although construction has been completed and handed over to home buyers, for many years, the land use fee at New City apartment building has not been appraised, causing residents to not be granted pink books due to many problems, including problems related to the time of determining land prices.
The second project mentioned in the resolution is the 30.2ha land plot in Binh Khanh ward and the 30.1ha land plot in Nam Rach Chiec, the commercial names of these two projects are The Water Bay and Lakeview City, invested by Novaland.

According to the resolution, the specific time for determining land prices to calculate land use fees for the 30.2ha land plot in Binh Khanh ward and the 30.1ha land plot in Nam Rach Chiec in report 332 is determined according to the following time points: For the exchanged land area corresponding to the amount of money the investor has invested in the 30.2ha land plot in Binh Khanh ward up to 2008 (compensation, support, and construction investment costs have been audited and appraised), the time for determining land prices is the time of completion of land recovery and compensation for the 30.2ha land plot in Binh Khanh ward (November 20, 2008).
For the land area for which land use fees have not been paid, the time for determining land price is the time when the competent state agency issues a decision to allocate land for the 30.1ha Nam Rach Chiec land plot (April 18, 2017).
The 30.2ha project was introduced to the market by Novaland in 2018 under the name The Water Bay, located on Mai Chi Tho street, the project has a scale of 12 blocks, providing about 5,000 apartments, 3,000 officetels and 250 shophouses.
Speaking to Tuoi Tre Online earlier, a representative of Novaland said that regarding The Water Bay project, this enterprise has repeatedly proposed to remove obstacles, helping the project continue to be built because the enterprise has invested a huge amount of money into this project, up to thousands of billions of VND.
The 30.1ha Nam Rach Chiec project (Lakeview City) has been put into use but the pink book has not been issued yet because the land use fee to be paid has not been finalized.
The Ho Chi Minh City Tax Department once issued a notice of land rent payment and a notice of land use fee payment with a total amount of nearly VND5,176 billion, but Novaland did not agree with determining the time to calculate land use fee as April 2017 because the enterprise had completed compensation in 2008.

Previously, Novaland said it had requested relevant agencies to thoroughly consider and handle the land pricing plan for this project.
People have the opportunity to be granted pink books
Regarding the "scandalous" project 39-39B Ben Van Don related to Ms. Nguyen Thi Nhu Loan (former general director of Quoc Cuong Gia Lai Joint Stock Company), the resolution has proposed a handling plan for continued land use, land price determination, land use fee calculation, and land rental for the project at 39 - 39B Ben Van Don (Ward 12, District 4) in the inspection conclusion No. 757 dated May 13, 2021 of the Government Inspectorate.

Accordingly, the resolution stipulates that investors are allowed to continue using land to implement projects after administrative and criminal handling of individuals and organizations that have committed violations, remedied economic violations, and recovered material benefits due to violations according to the legally effective verdict.
Thus, after the violations have been handled, residents who have purchased apartments in this project will be granted pink books.
According to the resolution, inspection and examination conclusions and verdicts that have come into force must be strictly implemented.
Only consider, handle, and remove difficulties and obstacles in the implementation of inspection and examination conclusions and judgments where the cause of violations and wrongdoings is due to the fault of the state management agency or the fault of both the state management agency and the investor; after strictly handling organizations and individuals who violate according to Party regulations and State laws and remedying the consequences of economic violations and recovering material benefits due to violations.
For projects and land within the scope of the resolution that are in the process of criminal proceedings, the application of the provisions of this resolution shall only be carried out after a judgment has come into legal effect or a decision to suspend the case is issued.
In case the judgment that has come into legal effect has a decision on land handling that is different from the provisions of this resolution, the judgment that has come into legal effect shall be implemented. In particular, the resolution also stipulates not to legalize violations, not to allow new violations to arise, and to inspect, supervise, and strictly handle organizations and individuals who take advantage of the implementation of the resolution to commit corruption and negativity.
