This morning, March 25, the 7th Conference of full-time National Assembly deputies to discuss draft laws submitted to the National Assembly at the 9th Session of the 15th National Assembly will be held. It is expected that in about 2 working days, the deputies will focus on discussing 9 draft laws, in which, some contents are assessed as very difficult, very new and need to be "exchanged back and forth" to be "ripe" and "clear".

Overall, the bills submitted to this Conference have undergone significant changes, especially in terms of shortening the provisions to ensure the spirit of innovation in law-making thinking: only regulating contents within the authority of the National Assembly, closely following reality, ensuring feasibility, enhancing decentralization and delegation of power, not regulating in the law the contents of administrative procedures, procedures, and records, but assigning the Government to regulate according to its authority to flexibly and promptly amend and supplement when necessary, in accordance with reality and meeting the requirements of administrative reform. There are bills that have reduced a large number of provisions compared to the draft submitted to the National Assembly at the Eighth Session, such as: the Chemicals bill (amended) reduced by 39 articles, the Digital Technology Industry bill reduced by 17 articles, 9 items, the Teachers bill reduced by 4 articles...

Conference to disseminate and implement laws and resolutions passed at the 9th Extraordinary Session of the 15th National Assembly

The reduction of provisions in each bill aims to build a more open legal system, but on the other hand, it must be admitted that when the National Assembly issues framework laws, it will pose a great challenge to putting laws and resolutions into practice because this also depends on the issuance of detailed regulations.

With the current innovation in law-making thinking, it is understandable that National Assembly deputies and even the agencies in charge of reviewing are focusing more on reviewing and removing provisions that are not within the National Assembly’s authority from draft laws. However, it seems that the deputies and even the agencies of the National Assembly have not really played their role in supervising and controlling detailed regulations in terms of both the progress of promulgation and the quality of the documents.

Prime Minister Pham Minh Chinh has repeatedly pointed out the shortcomings and limitations in the work of building and organizing the implementation of laws, emphasizing the situation of slow issuance of detailed regulations that have not been completely resolved, the work of monitoring, inspecting, urging, and evaluating the effectiveness of organizing the implementation of legal documents is still formal... On March 18, in the Prime Minister's Conclusion Notice, he also requested the Ministries of Justice, Home Affairs, Science and Technology, Construction, and Industry and Trade to take the lead in promptly, resolutely, and effectively implementing laws and resolutions according to their assigned functions and tasks. This Notice also clearly defines the deadline for submitting to the Government for promulgation in March 2025 for 7 decrees detailing the implementation of laws and resolutions passed by the National Assembly at the 9th Extraordinary Session. The Government also specifically requested to focus resources, urgently develop, promulgate according to authority and submit to the Government and Prime Minister for promulgation in March 2025, and at the latest in April 2025 for 45 documents detailing laws and resolutions that have come into effect, determined to completely resolve the situation of slow promulgation of detailed documents and speed up the progress of developing and promulgating 108 documents detailing laws and resolutions that will come into effect from April 1 and in the coming time.

The above figures of detailed regulations that are still slow and in arrears show that the Government and the National Assembly have made great efforts, working day and night to pass laws and resolutions, especially laws and resolutions that "pave the way" for breakthrough mechanisms and policies or pilot special, outstanding mechanisms and policies to handle arising practical problems, but to put the laws and resolutions into practice as required is still a difficult problem.

Decrees and circulars create "space" for flexible management of the Government, ministries and branches to proactively adapt to rapid and unpredictable changes in practical life. With such meaning, there is no reason for the delay in issuing detailed regulations, so it requires more effective solutions from the Government to completely handle this situation.

On the National Assembly side, the National Assembly Delegates' Conferences are full-time activities, the Committees' review, acceptance and revision sessions - where the delegates have time, conditions, in-depth expertise and follow the bills more closely, in addition to paying attention to thoroughly discussing policies and laws "at the level of law", it is necessary to pay special attention to how those laws will be specified in detailed regulations, which agency is assigned to preside over the issuance of detailed regulations and how much preparation has been made, whether the progress and content can be ensured so that when the law and resolution come into effect, the detailed regulations must also be issued and come into effect or not...

It is necessary to maximize and effectively use the "supervisory power" of the National Assembly, its agencies and National Assembly deputies over the work of law-making, especially detailed regulations. The more the framework law is developed, the more closely the National Assembly must supervise the progress and quality of these documents. Only then can the progress of bringing laws and resolutions into life be accelerated.
