The dedicated and quality comments of Ha Tinh delegates will contribute to perfecting the draft Law on Organization of People's Courts (amended).

Preparing for the 6th Session of the 15th National Assembly, on the morning of September 20, the Provincial National Assembly Delegation coordinated with the Provincial People's Court to organize a conference to collect comments on the Law on Organization of the People's Court (amended).

Deputy Head of the Provincial National Assembly Delegation Tran Dinh Gia and Chief Justice of the Provincial People's Court Phan Thi Nguyet Thu chaired the conference.

The amendment of the Law on Organization of People's Courts aims to continue to perfect the organizational structure, improve the quality, effectiveness, efficiency and prestige of the People's Courts; build a professional, modern, fair, strict and honest court system; fulfill the responsibility of protecting justice, protecting human rights, citizens' rights, protecting the interests of the State, protecting the legitimate and legal rights and interests of organizations and individuals.

The draft Law on Organization of People's Courts (amended) consists of 9 chapters and 151 articles; of which, 51 new articles are added, 93 articles are amended, and 7 articles are kept unchanged. Compared to the 2014 Law on Organization of People's Courts, the draft law has reduced 2 chapters and increased 54 articles. The draft law closely follows the purpose, guiding viewpoints and concretizes 6 groups of policies approved by the National Assembly in Resolution No. 89/2023/QH15 dated June 2, 2023.

The structure of the draft law includes: general provisions; tasks and powers of the People's Court; national judicial council; organizational structure; cadres, civil servants, public employees and other workers in the People's Court; jury; trial organization; ensuring the operation of the People's Court; enforcement provisions.

Lieutenant Colonel Nguyen Quang Thanh - Chief of Office of the Criminal Police Department (Provincial Police) said that it is necessary to protect vulnerable people and to have specific regulations for the competent authority to collect evidence.

Delegates attending the conference basically agreed with the content of the draft Law on Organization of People's Courts (amended). Some opinions said that the addition of the content of judicial power and the draft law is extremely necessary, important, and consistent with international practice; proposed to remove the court's authority to initiate criminal proceedings; agreed with the regulation that the court does not have the obligation to collect evidence; it is necessary to set out the court's responsibility in guiding and supporting the collection of evidence to protect vulnerable subjects.

Chief Justice of Thach Ha District People's Court Nguyen Thanh Nhan proposed to maintain the term of office of judges as per current regulations.

Delegates agreed with the policy of establishing specialized courts to increase the professionalism of the courts in handling certain types of cases of a special nature, requiring deep expertise; approved the draft law's plan on forming a national judicial council institution; maintaining the term of office of judges according to current regulations; having a regime to protect judges; and innovating the people's assessor institution.

Some delegates also proposed clarifying the legal status of the national judicial council; when establishing the national judicial council, it is necessary to enhance the supervisory role of the procuracy; not limit the time for audio and video recording at court sessions...

The opinions and recommendations at this conference will be compiled and completed by the Provincial National Assembly Delegation to submit to the National Assembly at the upcoming 6th Session.
