Violations at the project related to the Steel Corporation

On the afternoon of October 11, the Government Inspectorate (GIA) completed the inspection conclusion on the conversion of land use purposes from production and business land to land business and housing construction in the period 2011-2019 of state-owned enterprises and equitized enterprises for 9 land plots in 3 provinces and cities.

According to the inspection agency, the inspection process identified many violations at 9 projects in 3 provinces and cities (Hanoi, Ho Chi Minh City, Binh Duong). Thereby, the Government Inspectorate requested the Ministry of Public Security to receive records and documents to continue investigating, verifying and clarifying.

The project at 120 Hoang Quoc Viet was pointed out by the Government Inspectorate for many violations.

Specifically, in Hanoi, the Government Inspectorate requested the police to receive information and documents to consider investigating and handling the high-rise housing, office and service project at 120 Hoang Quoc Viet, Cau Giay district.

At this land plot, the inspection agency believes that the Hanoi People's Committee's approval of land use fees 57,595 billion lower than the land use right value approved by the Ministry of Industry and Trade in the enterprise value when equitizing Vietnam Steel Corporation (VNSTEEL), risks reducing the value of the equitized enterprise and will lead to a decrease in state budget revenue.

Next is the housing, office and commercial service complex project on Phap Van Street, Hoang Liet Ward, Hoang Mai District and the investment project to build a commercial, service and housing center at 275 Nguyen Trai Street, Thanh Xuan District.

Two projects in Ho Chi Minh City

In Ho Chi Minh City, the inspection agency "named" two projects, both in Hiep Binh Chanh ward, Thu Duc district, including: The office, commercial and residential building project at 244 Kha Van Can and the low-rise housing project at 5, street 22, quarter 4, Hiep Binh Chanh ward.

TTCP assessed that the fact that the Standing Vice Chairman of the Ho Chi Minh City People's Committee (at the time of inspection) signed a document approving the change of land use purpose for Toan Bo Materials and Equipment Joint Stock Company to the above two land plots violated the provisions of the 2003 Land Law, was not within his authority, leading to the approval of incorrect land use right value.

Series of projects in Binh Duong

Regarding Binh Duong province, the TTCP listed the projects and requested the Ministry of Public Security to verify and clarify violations, including: The Di An railway commercial apartment and housing project on an area of ​​96,504 square meters of land in Di An ward. According to the TTCP, the sale of 5 plots of land belonging to the project by the Di An Railway Development Company Limited is contrary to the detailed 1/500 planning approved by the People's Committee of Di An town.

This project was also identified as having signs of fraud and property appropriation. At the same time, the departments and branches advising the People's Committee of Binh Duong province approved the land price calculated according to the project implementation period adjusted from 3 years to 5 years at the request of the investor, leading to a reduction of more than 14 billion VND in land use fees, showing signs of loss and waste.

TTCP "named" Binh Duong Provincial People's Committee in the recently issued inspection conclusion.

Regarding the railway commercial housing project on an area of ​​over 64,000 square meters of land in Di An ward, according to TTCP, the People's Committee of Binh Duong province allowed Di An Railway Housing Development Company Limited to use the above area to implement the project, without auctioning the land use rights, which is a violation of the 2013 Land Law and shows signs of violating regulations on management and use of State assets, causing loss and waste.

Also in Binh Duong, the next project named is the railway commercial housing area expanded on an area of ​​more than 47,800 square meters of land in Di An ward.

The inspection agency determined that Di An Railway Development Company Limited had not been approved by the People's Committee of Binh Duong province and had not fulfilled its financial obligations regarding land use, had no land use rights, had not had its investment project approved, and had not been granted a construction permit, but had signed a capital mobilization contract, seriously violating regulations on capital mobilization for commercial housing development.

In addition, on January 19, 2021, the People's Committee of Binh Duong province issued a decision to revoke the previous decision allowing Di An Railway Development Company Limited to change the land use purpose to implement the project.

Di An Railway Development Company Limited has not been permitted to carry out the project, but the mobilized capital (since 2018) has not been repaid to customers with a very large amount (still owing about 191.7 billion VND), showing signs of fraud and property appropriation.
