Kinhtedothi - On March 17, speaking with Kinh te va Do thi newspaper, the leader of the Department of Home Affairs of Dak Nong province said that the Inspection Team announced the decision to inspect the Department of Construction on the arrangement of the organizational structure related to the department leadership positions to resolve the petition.
Previously, Mr. Ha Xuan Binh, born in 1975, former Head of Technical Infrastructure and Housing Management Department of Dak Nong Province Department of Construction, sent a petition to Dak Nong Provincial People's Committee requesting a review of the selection and arrangement of staff at this Department.
Including the transfer of Mr. Ha Xuan Binh from Head of Technical Infrastructure and Housing Management Department of the Department of Construction to Deputy Head of this department.
Upon receiving Mr. Ha Xuan Binh's petition, the Dak Nong Provincial People's Committee assigned the Department of Home Affairs to preside over and coordinate with relevant units to inspect, verify, and handle Mr. Binh's petition, ensuring compliance with regulations.
Accordingly, the Department of Home Affairs issued Decision No. 204/QD-SNV dated March 14, 2025 on the establishment of a Team to inspect the content of the petition (referred to as Inspection Team No. 204).
According to Mr. Ha Xuan Binh's petition, from February 2024 he was appointed to the position of Head of Technical Infrastructure and Housing Management Department, Dak Nong Department of Construction.
Implementing the policy of streamlining the apparatus, the Department of Construction merged with the Department of Transport to form the Department of Construction. Mr. Phan Nhat Thanh - Director of the Department of Construction (old) became Director of the Department of Construction (new).
Before the merger, the Department of Construction had 6 specialized departments and the Department of Transport had 5 specialized departments. After the merger, the total number of specialized departments of these two departments is 11, while the new apparatus has 8 departments.
Of the 11 comrades holding the position of Head of Department of the 2 departments before the merger, 3 comrades have submitted resignation applications and have been approved by competent authorities according to the policies and regulations stipulated in Decree 178/2025/ND-CP, including Ms. Nguyen Thi Nguyen - former Chief Inspector of the Department of Construction; Mr. Nguyen Chi Thanh - former Head of the Department of Transport, Vehicles and Drivers and Mr. Truong Duc Tuan - former Chief of Office of the Department of Transport.
According to Mr. Ha Xuan Binh, after the merger, the Department of Construction of Dak Nong province has 8 departments and 8 comrades are department heads (except for 3 retired comrades). Thus, according to the orientation and direction of the Dak Nong Provincial Party Committee, the Department of Construction must consider arranging all the head positions without having to carry out the selection process. However, the Board of Directors of the Department of Construction of Dak Nong province still conducts the staff selection process and includes in the selection list the comrades who have decided to retire as mentioned above.
Specifically, on February 28, 2025, the Department of Construction issued Document No. 454/SXD-VP on the implementation of personnel work after the merger, in which it still advised Comrade Nguyen Chi Thanh as Head of the Vehicle and Driver Department, while the Department of Transport issued Decision No. 472/QD-SGTVT dated February 28, 2025 on early retirement from March 1, 2025 for Comrade Nguyen Chi Thanh.
On March 5, the Director of the Department of Construction signed a decision to transfer and appoint Mr. Nguyen Dung as Deputy Head of this Department.
On the same day, March 5, the Director of the Department of Construction transferred and appointed Mr. Ha Xuan Binh from Head of Technical Infrastructure and Housing Management Department to Deputy Head of this department.
According to Mr. Ha Xuan Binh, the transfer of his position is unreasonable. Because in Official Dispatch No. 2152 dated February 26 of Dak Nong Provincial Party Committee stated: It is necessary to consider arranging all the positions of chiefs, in case of surplus chiefs, then arrange deputy chiefs; in case of no surplus chiefs, the competent authority shall consider and arrange the position of chief for the current chief leader of the unit, without having to carry out the selection process.
Dissatisfied with the transfer decision, Mr. Ha Xuan Binh sent a petition to the Dak Nong Provincial People's Committee requesting a review of the selection and arrangement of staff at the Department of Construction.
