Today, February 12, the National Assembly discussed the Draft Law on amending and supplementing a number of articles of the Law on Organization of the National Assembly and the Draft Law on Promulgation of Legal Documents (amended).

Delegates said that one of the major changes in the draft law is to make the drafting process more flexible, shortening the time to speed up decision-making and "transferring roles" to the Government.

Accordingly, the National Assembly will decide whether to approve or not to approve draft laws, while the detailed contents will be regulated by the Government. This can speed up decision-making but also leads to passivity among people and businesses.

According to the delegate, National Assembly deputies often listen to public opinion more than ministries and branches, so "transferring roles" to the Government means that public opinion through press channels and social networks will face some limitations.

In addition, one of the important issues that delegates are concerned about is that currently, many agencies post drafts on separate websites, making it difficult for people and businesses to follow.

According to the delegate, the publication needs a common portal to post all versions of the draft, while ensuring that related documents such as presentations and explanatory reports are also made public for people and businesses to easily access information.

Another issue that delegate Ha Sy Dong mentioned in the discussion session was the use of the simplified procedure when issuing legal documents. In 2025, the Government plans to issue 130 documents, of which 69 documents will apply the simplified procedure. This procedure helps to make decisions quickly, but limits the time for consultation. Even though the simplified procedure is applied, it is still necessary to ensure the transparency of information on the electronic information portal so that the media, press and people can review it.

Participating in the discussion session, delegate Hoang Duc Thang, Deputy Head of the Delegation in charge of the National Assembly Delegation of Quang Tri province, gave his opinion on the Law amending and supplementing a number of articles of the Law on Organization of the National Assembly and the Draft Law on Promulgation of Legal Documents (amended).

In particular, in Clause 1, Article 1 of the Amendment and Supplement to a number of Articles of the Law on Organization of the National Assembly (amending and supplementing Article 5) it is mentioned that "The National Assembly promulgates laws to regulate the following contents: a, b, c ... l". However, delegates said that regulating the contents in detail would make it difficult to fully cover the institutions and fields that the 2013 Constitution has stipulated.

The delegate stated that according to the 2013 Constitution, the authority of “the National Assembly exercises the constitutional and legislative powers” ​​is stipulated. The 2013 Constitution has 10 institutions and areas that must be institutionalized by the National Assembly by law. Therefore, the delegate suggested that the Drafting Committee list the legal authority to implement the provisions of the Constitution or list all 10 institutions and areas in the Constitution, and consider not listing the provisions in Point 1, Clause 1 of the draft.

Regarding the provisions in Clause 3, Article 1 of the draft on amending and supplementing Clause 1, Article 30 of the Law on Organization of the National Assembly, the delegate suggested that the Drafting Committee review and adjust it in the direction that based on professional capacity, work requirements and ability to participate in the activities of the National Assembly's specialized agencies, National Assembly deputies can register to become members of the Nationalities Council or a committee of the National Assembly.

In addition, delegates were also concerned about the issue of funding and facilities for the activities of the provincial National Assembly delegation and emphasized: The drafting committee needs to consider and study specific provisions in the law on funding for the activities of local National Assembly delegations from both central and local sources so that localities have a basis for implementation.

Regarding the draft Law on Promulgation of Legal Documents (amended), delegate Hoang Duc Thang affirmed: Amending the Law on Promulgation of Legal Documents is an urgent requirement to meet practical demands and changes in the country's political, economic and social systems. In the context of the Party and State's efforts to innovate and improve the law-making process, amending the law is not only a technical legislative task but also a strategic step to improve the effectiveness and efficiency of state management.

The delegate proposed to add the word “country” before the phrase “Socialist Republic of Vietnam” in the following provisions: Clause 2, Article 5; Clause 1, Article 28; Clause 1, Article 29; Point d, Clause 4, Article 31; Point c, Clause 4, Article 34; Point d, Clause 4, Article 37; Point d, Clause 1, Article 50; Clause 1, Article 54; Clause 5, Article 58.

Research and add the principle of ensuring stability when building and promulgating laws in Article 5 of the draft such as: "Ensure stability, avoid frequent amendments, unless there are major changes in policies or practices that pose urgent requirements"; add the content that all Vietnamese citizens have the right to participate in giving opinions on policies and draft legal documents in Clause 3, Article 6 of the draft.
