Among them, Mr. Nguyen Van Trong, an accountant of Quynh Ba commune, Quynh Luu district, is the younger brother of Mr. Nguyen Van Quy, currently the Vice Chairman of Quynh Luu district, who directly approved the land price, appraised and determined the starting price of the land lots put up for auction.

"After the auction, before issuing a decision to recognize the auction results, the district discovered that Mr. Nguyen Van Trong had violated the law and was not allowed to participate in the auction, so it decided not to recognize the results for him," said the Chairman of the People's Committee of Quynh Hung commune.

Of which, the person who won the least auction for one plot of land, 2 people who won the most auctions for 23 plots of land and 20 plots of land.

According to the Chairman of the People's Committee of Quynh Hung Commune, in addition to Mr. Nguyen Van Trong winning 23 lots, the person who won 20 lots was Mr. Nguyen Van Tu, Mr. Trong's son. "Mr. Trong's son did not violate the law, so the results were still recognized as normal. The auction was conducted in the form of secret ballot, taking place publicly, under the supervision of many people," said the Chairman of the People's Committee of Quynh Hung Commune.

Regarding this, Mr. Nguyen Van Trong, accountant of Quynh Ba commune, confirmed that he had received a notice to cancel the results of the 23 land lots that he had just won the auction. Currently, the land auction organization has also notified Mr. Trong to return his deposit.

Mr. Trong said that when he heard that 56 plots of land in Dong Quan area would be auctioned, a relative of his who is doing business in Hanoi did some research and decided to buy 4,000 square meters of land in this area for business.

However, later, due to health reasons, this person could not return directly to participate in the land auction. Therefore, this person later asked Mr. Trong for support in participating in the land purchase.

“I paid a deposit of 20% of the value of the auctioned land lot. When I prepared the land auction documents, I did not tell Mr. Quy (Vice Chairman of the People's Committee of Quynh Luu District) so he did not know. Actually, I did not know that participating in the land auction was wrong. If I had known, I would not have done it because it was a waste of time,” Mr. Trong explained.

Request to re-auction 23 land lots

Mr. Nguyen Van Quy, Vice Chairman of Quynh Luu district, affirmed that during the auction, although they were brothers, Mr. Nguyen Van Trong did not speak or ask for opinions, so he did not know how to give instructions and ensure compliance with legal regulations.

“The auction results were assessed by the monitoring unit as being objective and fair, without any collusion or collusion. It can be affirmed that the original purpose of the auction was to achieve good results,” Mr. Quy said.

The Vice Chairman of Quynh Luu District said that the process of setting the starting price for the auction is a collective one. Specifically, the district hired an independent consulting unit with the function of price appraisal.

After this unit sent the certificate, the district's valuation council met to discuss, and the Finance Department advised the district People's Committee to make a decision. He himself only signed the decisions on behalf of the Chairman and the district People's Committee, not the person who directly made the decisions.

Discussing further about the auction day, the Vice Chairman of Quynh Luu district said that based on the starting price, whoever bids higher will win. To win all 23 plots, on average, Mr. Trong had to raise the price of each plot from 300 million to 800 million VND compared to the original starting price. Accordingly, on average, each plot of land that Mr. Trong won the auction was worth more than 1 - 1.8 billion VND.

The land auction situation in Quynh Luu district in the past 6 months has achieved very low results, only reaching over 280 billion VND. In which, many communes such as Quynh Giang, Quynh Lam, Son Hai... auctioned land but had no results.

“The auction process was at the stage under the responsibility of the auction company when the district discovered the above violation. Immediately, the district requested to stop and issued a decision not to recognize Mr. Trong's auction results, and requested a re-auction,” said Vice Chairman of Quynh Luu district.

As reported, after the auction supervision team reported on June 28, 2023 that the auction winner of 23 land lots in Quynh Hung commune was the younger brother of the person who signed the decision approving the starting price of the auctioned land lots, the People's Committee of Quynh Luu district did not recognize the auction results and directed verification and clarification.

The People's Committee of Quynh Luu district assigned the auction company to urgently complete procedures to handle 23 residential land lots that were announced by the company's auctioneer as winning bids but violated the law; report and clearly explain responsibilities in the process of implementing the auction process and procedures for errors.
