The Government has just issued Resolution No. 74 promulgating the Plan to implement the arrangement of administrative units and build a model of organizing two-level local government (Plan).
The Institute issues a Plan to clearly define the roadmap and tasks to be performed at each point in time, ensuring that it is consistent with reality in order to successfully implement the goals, requirements, tasks, and solutions stated in the Conclusions of the Politburo and the Secretariat.
Clearly assign tasks, responsibilities and coordination among relevant ministries, branches, provincial (municipal) Party Committees, People's Councils, People's Committees of provinces and centrally-run cities and relevant agencies in directing and organizing implementation.
The Government issued a Plan to implement the arrangement of administrative units and build a two-level local government organization model.
Summary of administrative unit arrangement at all levels before September 20
According to the Plan, before April 18, the Ministry of Home Affairs will preside over and coordinate with relevant ministries and branches to organize a national conference to deploy to central ministries and branches and localities right after the Politburo's dissemination conference.
Regarding the implementation of the arrangement and reorganization of commune-level administrative units, according to the Plan, the Provincial People's Committee shall prepare a project dossier before May 1. Before May 30, the Ministry of Home Affairs shall appraise and prepare the Government's project dossier to submit to the National Assembly Standing Committee.
Regarding the implementation of the arrangement of provincial administrative units, the Plan clearly states that before May 1, the provincial People's Committee will prepare a project dossier. Before May 30, the Ministry of Home Affairs will prepare a project dossier of the Government to submit to the National Assembly. The Committee on Law and Justice will review it, and the National Assembly will consider and approve it before June 20.
According to the Plan, summarize the arrangement of administrative units at all levels before September 20.
Submit to the Government for promulgation of Decree on the number of Vice Chairmen of People's Committees at all levels before June 30
One of the tasks and solutions proposed by the Government in this plan is to perfect policies, laws and guiding documents as a basis for the arrangement of administrative units and organization of two-level local governments.
The Government requests that central ministries and branches proactively propose and submit to competent authorities for promulgation or promulgate under their authority legal documents and guidance documents to resolve issues related to the arrangement of administrative units, termination of operations of district-level administrative units and organization of two-level local governments.
According to the Government's request, after the administrative unit arrangement, it is necessary to ensure that the two-level local government organization operates smoothly, without interruption, and without legal gaps. The completion date is before June 30.
Ministries and ministerial-level agencies shall preside over and review the tasks, powers, competences, and administrative procedures of district-level authorities within the management areas of their ministries and branches, and the contents that can be decentralized from the Government, Prime Minister, Ministers, and Heads of ministerial-level agencies to local authorities at provincial and commune levels.
On that basis, proactively issue according to authority or propose and report to the Government to issue documents on regulations other than laws, resolutions of the National Assembly, resolutions and ordinances of the National Assembly Standing Committee. Completion date is before June 30.
In particular, the Government assigned the Ministry of Home Affairs to advise and submit to the Government for submission to the National Assembly to promulgate a new Law replacing the Law on Organization of Local Government in 2025; a new Law replacing the Law on Cadres and Civil Servants in 2008 (amended and supplemented in 2019). The completion date is before April 30.
The Ministry of Home Affairs shall advise and submit to the Government to submit to the National Assembly Standing Committee a draft Resolution on the arrangement of administrative units in 2025 before April 8.
Before June 30, the Ministry of Home Affairs shall preside over and coordinate with ministries, branches and localities to submit to the Government a Decree replacing Decree No. 61/2018 of the Government on implementing the one-stop, one-stop mechanism in handling administrative procedures; submit to the Government a Decree regulating the number of Vice Chairmen of the People's Committee and the process and procedures for electing, resigning, dismissing, removing, transferring, and removing members of the People's Committee, and delegating the authority of Chairmen of the People's Committees at all levels; submit to the Government a Decree regulating the organization of specialized agencies under the People's Committees of wards, communes and special zones; job positions associated with the payroll of each specialized agency under the People's Committees of wards, communes and special zones.
At the same time, the Ministry of Home Affairs needs to submit to the Government a Decree amending and supplementing the table of allowances for leadership positions in state agencies, state-owned enterprises; agencies and units under the People's Army and the People's Public Security issued together with Decree No. 204/2004 of the Government on salary regime for cadres, civil servants, public employees and armed forces; issue a Circular guiding on regional allowances, attraction allowances for cadres, civil servants, public employees and armed forces; and areas applying the minimum wage for employees in the enterprise sector.
Arrange tax authorities, State Treasury, customs... to suit the province merger
Before November 1, the Ministry of Home Affairs shall preside over and coordinate with central ministries, branches and localities to issue a Circular regulating the establishment and management of administrative unit boundary records.
The Ministry of Home Affairs is also assigned to preside over and coordinate the issuance of guidelines on standards for titles, ranks, and regimes and policies on salaries and allowances for cadres and civil servants in wards, communes, and special zones when implementing the arrangement of commune-level administrative units; building job positions associated with the payroll of each specialized agency under the People's Committee of wards, communes, and special zones; the arrangement and assignment of cadres, civil servants, and public employees when merging provincial-level administrative units, reorganizing communes, and organizing the implementation of two-level local government before April 10.
Before April 10, the Government assigned the Ministry of Home Affairs to coordinate with relevant ministries and branches to advise the Government Steering Committee to direct the Ministry of Finance, the State Bank of Vietnam, and relevant agencies to continue researching and having plans to arrange tax agencies, the State Treasury, customs, social insurance, statistics, banks, etc. in accordance with the merger of provincial-level administrative units and the implementation of the 2-level local government organization model.
The Ministry of Justice is assigned to advise and submit to the Government for submission to the National Assembly for promulgation of the Law amending and supplementing the Law on Promulgation of Legal Documents and the Resolution amending and supplementing Resolution No. 190 of the National Assembly regulating the handling of a number of issues related to the arrangement of the State apparatus or a new Resolution regulating the handling of a number of issues related to the organization of two-level local governments (if necessary). Completion date is before May 15.
Before April 10, the Ministry of Justice shall preside over and coordinate with relevant ministries and branches to submit to the Prime Minister for assignment of ministries and ministerial-level agencies to develop and submit to the Government for promulgation Decrees in specialized fields related to the organization, tasks and powers of local governments at provincial and communal levels.
Before April 10, the Ministry of Justice shall issue guidelines for handling issues arising in the fields of civil status, registration of security measures when implementing the arrangement and reorganization of administrative units at all levels... and other related issues under the State management of the Ministry of Justice.
The Ministry of Agriculture and Environment shall preside over and coordinate with relevant ministries and branches to issue: Guidelines for reviewing, supplementing and adjusting issues related to new rural construction and policies under the National Target Program on New Rural Development, projects, sub-projects, activities under the National Target Program on Sustainable Poverty Reduction of administrative units implementing rearrangement and reorganization... and other related issues under the State management of the Ministry of Agriculture and Environment before April 10.
Before April 10, the Ministry of Public Security shall preside over and coordinate with relevant ministries and branches to issue guidelines for recalling old seals, engraving seals, and changing citizens' residential addresses due to changes in boundaries and names of administrative units with the national database system on population, citizen identification and electronic identification; removing obstacles regarding judicial records; reviewing and providing data on actual population at administrative units at all levels... and other related issues under the State management of the Ministry of Public Security.
Before April 10, the Ministry of National Defense shall preside over and coordinate with relevant ministries and branches to issue guidelines for reviewing and identifying administrative units in border areas and key defense areas; building military defense zones when organizing two-level local governments; organizing the building of militia and self-defense forces in administrative units subject to rearrangement and reorganization,... and other related issues under the state management of the Ministry of National Defense.
The Ministry of Finance shall preside over and coordinate with relevant ministries and branches to issue procedures for adjusting investment projects in case of changes in administrative boundaries; changes in information in business registration certificates, cooperatives, business households, and business licenses of individuals and organizations when reorganizing administrative units and organizing two-level local governments; advise competent authorities to provide financial support to localities (provincial level) with financial difficulties when reorganizing administrative units under the direction of competent authorities. Completion date is before April 10.
Before April 10, the Ministry of Ethnic Minorities and Religions shall preside over and coordinate with relevant ministries and branches to issue guidelines for implementing the regimes and policies of the National Target Program on Socio-Economic Development for Ethnic Minorities and Mountainous Areas in administrative units implementing the rearrangement...
