On the afternoon of October 26, the National Assembly continued to discuss the Report of the monitoring delegation and the draft Resolution of the National Assembly on the results of the thematic monitoring of "the implementation of policies and laws on real estate market management and social housing development from 2015 to the end of 2023".
Speaking at the discussion, National Assembly delegate Le Thanh Hoan said that the Report and draft Resolution on supervision have assessed and proposed solutions to resolve the interests of people and businesses regarding the real estate market.

However, Mr. Hoan said that it is necessary to clarify the non-legalization of real estate violations. This is a very complicated issue, because it is difficult to have a general regulation that is correct for all cases.
"With the spirit of not legalizing violations and having to find mechanisms and policies to free up resources while still complying with the law, this is a difficult problem and needs to be concretized and soon have policies from competent authorities," said Mr. Hoan.
Delegate Le Thanh Hoan said that we need to determine that if the violation of the law is serious, we have reviewed and summarized the implementation of the law and found no problems in practice, then we must thoroughly enforce and overcome the violation.
"If we consider that the law is really inappropriate and needs to be revised and supplemented and approved by competent authorities, then we should retroactively exempt ourselves from responsibility. There needs to be a solution to harmonize interests, especially focusing on the interests of the people, the community and the State," Mr. Hoan proposed.

"The nature of the people who file complaints is to want housing rights, not to bring the case to the attention of the investor, which could lead to prosecution or to local comrades being implicated. There are people who have contributed, and are only one or two months away from retirement, but are caught up in legal trouble because they signed contracts more than 10 years ago, while the violation was only because the policy at that time was not clear," said Mr. Huan.
Mr. Huan also said that looking back 10 years ago is very easy now, but at that time it was difficult.
"It's easy to look at the present time 10 years from now, but at the present time, there are 50-50% decisions that cannot be ignored," delegate Huan analyzed and suggested that the Resolution could provide a mechanism to respect the law on the one hand, but on the other hand, maintain the humanistic spirit of the socialist rule of law state.

Confused because of not knowing how to "legalize violations"
Delegate Nguyen Van An (Thai Binh delegation) said that, in general, the tasks and solutions proposed in the draft Resolution on continuing to improve the effectiveness and efficiency of implementing policies and laws on real estate market management and social housing development are not really specific enough to be able to implement and overcome the limitations as stated in the Monitoring Report.
Regarding land valuation, delegate An said that although the Report pointed out many shortcomings, limitations and major obstacles in land valuation. However, the solutions related to land valuation proposed in the draft Resolution are still general and not specific enough to solve practical problems.
Therefore, Mr. Nguyen Van An said that it is necessary to review and perfect solutions in a more specific direction, with a clear implementation timeline to remove obstacles.
In addition, the draft Resolution also stipulates the non-legalization of violations to improve the effectiveness of law making and enforcement. Regarding this content, delegates suggested that it is necessary to consult with government agencies and have specific instructions on the legalization of violations.
