Land brokers cheated people out of capital contributions and paperwork, appropriating nearly 6 billion VND

On December 12, the People's Court of Da Nang City tried Nguyen Van Thu (41 years old, residing in Tho Quang ward, Son Tra district, Da Nang city) for the crime of "Fraudulent appropriation of property".

According to the indictment, in January 2021, Nguyen Van Thu introduced Ms. Le Thi Kim Hue (42 years old, residing in Cam Le district, Da Nang city) to buy 2 plots of land No. 545a, 545b in Ha Tay block, Dien Hoa ward, Dien Ban town, Quang Nam province from Mr. Nguyen Huu Quang for 540 million VND.

These are plots of land for growing crops and Thu committed to completing the procedures to convert the land use purpose to residential land, so Ms. Hue agreed to buy them.

On January 26, Thu and Ms. Hue signed a written agreement stating that Thu would help Ms. Hue complete the procedures to change the land use purpose for 1.533 billion VND, and Ms. Hue paid 765.5 million VND in advance.

After that, Ms. Hue gave Thu another 30 million VND to help level the ground and lent Thu 30 million VND to solve personal matters.

Then, in March 2021, Thu invited Ms. Hue to contribute money to invest in buying 9 plots of land on plot 591, map sheet number 14, area of more than 2,800m2 in Hoa Quy ward, Ngu Hanh Son district, Da Nang.

Trusting, Ms. Hue agreed to contribute more than 5.3 billion VND but paid 2.7 billion VND in advance and the two parties signed a capital contribution contract.

After receiving money from Ms. Hue, Thu spent it and did not fulfill her commitment, so Ms. Hue filed a complaint.

During the investigation, the police determined that the plots of land in plot 591, map sheet number 14 were purchased by Mr. Vo Ngoc Chien (residing in Quang Nam province) and asked Thu to help with the procedures to change the land use purpose for 7.8 billion VND. Mr. Chien gave Thu 2.448 billion VND in advance and was misappropriated.

The indictment concluded that Thu appropriated a total of more than 3.5 billion VND from Ms. Hue and 2.448 billion VND from Mr. Chien.

In court, Thu confessed that she worked as a land broker and used the money she embezzled from the victims to buy houses, pay debts, and spent it all, leaving her with no ability to pay.

The People's Court of Da Nang City sentenced Nguyen Van Thu to 17 years in prison for "fraudulent appropriation of property", forcing the defendant to compensate the entire amount of money he had appropriated from the victims.
