What does Da Lat report about violations at Cu Hill?

On the afternoon of January 12, the People's Committee of Da Lat City reported to the People's Committee of Lam Dong Province about the case of Hoang Gia DL Joint Stock Company building a golf club in Cu Hill.

Regarding this project, previously, on April 25, 2023, the People's Committee of Ward 1 (Da Lat) coordinated with the City's Urban Management Department to inspect the construction of the golf club building and discovered and recorded many violations.

Accordingly, Da Lat City recorded that this project was granted construction permit No. 02/GPXD by the Department of Construction of Lam Dong province on January 12, 2023, allowing Hoang Gia DL Joint Stock Company to build part of the basement of block 1 with a total floor area of ^{​​2,639m2} . However, the investor built 1 basement, 1 ground floor and 1 floor. The area of ​​violation is up to ^3,333m2 .

In addition, with block 2 constructions without construction permits (scale of 2 basements, 1 ground floor, 2 floors), the total area of ​​violation is up to ^20,406m2 .

According to the People's Committee of Da Lat City, on November 9, 2023, the Department of Construction of Lam Dong issued Decision No. 170/QD-SXD and Notice No. 2782/TB-SXD on the inspection of compliance with legal regulations on construction order at the golf club building project of Hoang Gia DL Joint Stock Company, but did not coordinate with the People's Committee of Da Lat City to conduct the inspection.

On November 10, 2023, Hoang Gia DL Joint Stock Company issued Document No. 69/HGDL requesting to postpone the inspection of investment and construction of the golf club building.

On November 18, 2023, Ward 1 People's Committee coordinated with the Urban Management Department to continue to inspect and re-examine the implementation of the suspension of the project. Through the inspection, the delegation requested Hoang Gia DL Joint Stock Company to strictly comply with the suspension of construction and implement measures according to the commitment form established on April 26, 2023.

Regarding the violations at Cu Hill in Da Lat, the People's Committee of Da Lat City issued two decisions to impose fines totaling VND240 million. On January 11, the People's Committee of Lam Dong Province issued a document requesting Hoang Gia DL Joint Stock Company to voluntarily dismantle illegal and unlicensed construction items.

The handling of violating construction works has been directed by the People's Committee of Da Lat City to the Urban Management Department and the People's Committee of Ward 1 to carry out in accordance with the authority and responsibility assigned by the Provincial People's Committee in Decision No. 31/2022/QD-UBND dated May 16, 2022 of the People's Committee of Lam Dong Province promulgating the Regulations on construction order management, decentralization of construction order management and receiving notices of commencement of construction with construction design documents in the area.

Regarding the delay in preparing a file to handle violations of construction order of Hoang Gia DL Joint Stock Company, the People's Committee of Da Lat City gave the reason that Ms. Le Thi Hong Xuan (residing on Yersin Street, Ward 1, Da Lat City, is the legal representative), at the time of inspection, guidance, and preparation of a file to handle violations after April 2023, was not present in the locality (on a business trip outside the province) and did not have a power of attorney as prescribed by law, so the handling of violations was prolonged.

At the same time, determining the violating construction items requires accurately identifying the items and violations to avoid duplication in handling violations by competent authorities.
