According to the President of the Vietnam General Confederation of Labor, 75% of the union budget has been spent on taking care of workers at the grassroots level. The vast majority of National Assembly deputies also agreed to maintain the union budget of 2%.
On the morning of October 24, at the 8th Session of the 15th National Assembly, National Assembly deputies discussed in the hall a number of contents of the draft Law on Trade Unions (amended).
Should maintain 2% union funds
Proposing to continue maintaining the 2% union fund and regulations as in the draft law, delegate Tran Nhat Minh (National Assembly Delegation of Nghe An Province) said that the union fund has been maintained and promoted effectively since 1957 - when the Trade Union Law was first issued. The purpose of the regulation is to take care of the lives of union members and workers at grassroots unions.

According to delegate Tran Nhat Minh, it is necessary to legalize and continue to maintain the 2% union fund as in the draft Law on Trade Unions (amended): "This fund is used at grassroots trade unions mainly to take care of the lives of union members and workers, such as visiting, sick leave, Tet gifts, birthday gifts, cultural and sports activities of union members and workers".
According to delegate Tran Kim Yen (Ho Chi Minh City National Assembly Delegation), ensuring the maintenance of 2% union funds also ensures the independence of the Vietnam General Confederation of Labor (VGCL) in caring for and protecting the legitimate rights and interests of union members and workers.
Delegate Le Thi Thanh Lam (National Assembly Delegation of Hau Giang Province) said that in practice, the 2% revenue source is an important foundation to help the union build a strong enough foundation to take good care of union members and workers. Thereby, creating an increasingly better connection in all activities between the union and workers.
Agreeing with the above views, delegate Chu Thi Hong Thai (National Assembly Delegation of Lang Son province) said that maintaining union funds is to take care of union members, workers and reduce the burden on the State budget.
Amending the law to make Vietnam Trade Union stronger
On behalf of the drafting agency, Mr. Nguyen Dinh Khang - President of the Vietnam General Confederation of Labor - explained and accepted the opinions of National Assembly Deputies on a number of major issues in the draft Law on Trade Unions (amended).
Mr. Nguyen Dinh Khang said that the Vietnam General Confederation of Labor respectfully accepts the opinions of delegates and accepts revisions in the process of completing the draft Trade Union Law (amended).
The President of the Vietnam General Confederation of Labor emphasized that the amendment of the Trade Union Law must ensure the thorough understanding and institutionalization of the Party's innovative viewpoints and guidelines related to national construction and development; be consistent with the 2013 Constitution, ensure the unity and synchronization of the current legal system, and ensure the Party's absolute and comprehensive leadership over trade union organizations.

Stating the purpose of amending the Trade Union Law, the President of the Vietnam Confederation of Labor said: "The amended Trade Union Law must be such that the Vietnam Trade Union, a large political and social organization of the working class and laborers, grows stronger, operates effectively and attracts a large number of laborers to participate."
At the same time, the Trade Union Law (amended) needs to inherit and maintain the contents that have proven reasonable, stable and effective in the recent implementation process. The Law amendment must refer to and selectively absorb international experience, ensuring conformity with the political system, the requirements for developing a socialist-oriented market economy and international integration under the leadership of the Communist Party of Vietnam.
Regarding union funds, the President of the Vietnam General Confederation of Labor stated that the majority of delegates agreed with the 2% level. During the drafting process, the Vietnam General Confederation of Labor had a report on receiving and explaining relevant opinions on union funds. Accordingly, of the 2% union funds, up to 75% is left to grassroots unions to take care of union members and workers.
Mr. Nguyen Dinh Khang welcomed the fact that business owners at enterprises have higher welfare regimes, which are beneficial to workers.
A noteworthy point in the draft revised Trade Union Law is that with the difficulties of struggling businesses, the Drafting Committee and the Reviewing Agency have designed Article 30 to add provisions on exemption, reduction, and suspension of trade union fee payments.
Regarding the entry and operation of foreign workers in the Vietnam Trade Union, Mr. Nguyen Dinh Khang said that the majority of opinions of the National Assembly deputies agreed with the regulation allowing foreign workers to have the right to join and operate in the Vietnam Trade Union. This is consistent with the provisions of the 2019 Labor Code and the trend of Vietnam's deep international integration. The Vietnam General Confederation of Labor has also researched and proposed a number of specific solutions reflected in the draft law in Article 5 and the Charter of the Vietnam Trade Union to limit any negative impacts, if any. |
