Warning of fraud in sending workers to Korea for seasonal work

On August 2, the Department of Overseas Labor Management (Ministry of Labor, Invalids and Social Affairs) informed that recently the Department has received many reports from workers about being scammed by brokers and sent to Korea for seasonal work.

Accordingly, the subjects of invitation and promotion can send workers to do seasonal work in Korea under C4 and E8 visas, according to the agreement signed between Vietnamese localities and Korean localities.

Notably, the brokers committed to ensuring the procedures for sending workers to Korea under this program to illegally collect money from the workers.

"Only workers in 12 localities including Da Nang, Dong Thap, Thai Binh, Ha Nam, Ha Tinh, Thua Thien Hue, Ca Mau, Quang Binh, Hau Giang, Ha Giang, Lai Chau and Tuyen Quang that have signed agreements with Korean localities are allowed to go under the program.

"No other agency, organization or individual is allowed to recruit and dispatch seasonal workers," the Department of Overseas Labor Management affirmed.

For workers in localities that do not have agreements with Korean localities, the broker also promises to transfer household registration to localities that have agreements with Korea to collect more money from the workers.

The Department of Overseas Labor Management has requested the police of several localities to investigate the illegal acts of several organizations such as T&Q International Travel and Study Abroad Consulting Services Trading Company Limited, L&R Travel Trading and Services Company Limited... These are the entities that have organized the selection and collected money from workers to commit to sending them to work seasonally in Korea (under E8 visa).

According to the Department of Overseas Labor Management, seasonal labor dispatch is a program for foreigners implemented by Korea and the Vietnamese Government continues to allow localities to pilot implementation from January 1, 2022.

To date, this program has only been implemented in 12 localities including Da Nang, Dong Thap, Thai Binh, Ha Nam, Ha Tinh, Thua Thien Hue, Ca Mau, Quang Binh, Hau Giang, Ha Giang, Lai Chau and Tuyen Quang.

To avoid being scammed, the Department of Overseas Labor Management recommends that workers only register to participate in the program through the Department of Labor, Invalids and Social Affairs and the Employment Service Center, and not register to participate with any brokerage organization or individual.

"Only workers in the 12 localities that have signed agreements with the above-mentioned Korean localities are allowed to go under the program. Any other agencies, organizations or individuals are not allowed to recruit and dispatch seasonal workers," the Overseas Labor Management Department affirmed.

This agency added that in localities implementing the program, the Department of Labor, Invalids and Social Affairs is the implementing management agency and the Employment Service Center under the Department of Labor, Invalids and Social Affairs is the unit directly selecting, completing documents and sending workers to work in Korea.

To avoid being scammed, the Department of Overseas Labor Management recommends that workers need to find out information clearly and only register to participate in this program through local authorities such as the Department of Labor, Invalids and Social Affairs and the Employment Service Center, not register to participate with any brokerage organization or individual.

Previously, on June 30, the Korean Ministry of Justice issued Order No. 1054 announcing adjustments to some contents of the "Immigration Management Law Enforcement Rules".

Accordingly, the Korean side allows E8 seasonal workers to extend their stay, the total stay not exceeding 8 months from the date of entry. This amendment will be applied from June 30, 2023 to seasonal workers working in Korea.

To avoid being scammed, workers should only register to participate in this program through local authorities such as the Department of Labor, Invalids and Social Affairs and the Employment Service Center, and not register with any intermediary organizations or individuals.

Seasonal labor in Korea applies to workers aged 30-55, who are long-term residents in the locality signing the Agreement; and have full civil capacity.

No criminal record and not subject to a ban on exiting the country or temporary suspension of exit as prescribed by law; healthy enough to work abroad; currently working in the fields of agriculture, fisheries, etc.

Under this program, workers are paid according to the minimum wage prescribed annually by Korea. For 2023, the salary is 2,010,580 KRW/month, equivalent to about 36 million VND.

Workers enjoy working hours, rest, working conditions, food, accommodation, living expenses, insurance, medical examination and treatment costs according to Korean regulations and are partially supported by Korean localities to buy round-trip airfare...
