Ho Chi Minh City People's Committee announces information on banning the Chairman of the Board of Directors of AISVN International School from leaving the country.
Regarding the case of AISVN International School, on March 27, the Ho Chi Minh City People's Committee sent a report to the Ministry of Education and Training about the school's activities.
According to the assessment of the Ho Chi Minh City People's Committee, the incident at AISVN International School was caused by Ms. Nguyen Thi Ut Em, Chairwoman of the Board of Directors, who signed many contracts in the form of loans with a number of parents whose children were studying at the school. These included the following terms: Loans, no interest on the loan amount during the time the student participates in the training program. When the student finishes the training program, the school will repay the loan amount within a certain period of time.
However, according to the opinion of the City Police, the contract signed between the school and the parents is a civil contract, with no binding content on the responsibilities between the parties, so there is no basis for the investigation agency to investigate the case.
In the report of the Ho Chi Minh City People's Committee sent to the Ministry of Education and Training, it stated: Currently, the authorities are implementing measures to ban Ms. Nguyen Thi Ut Em from leaving the country.

In addition, according to the assessment of the interdisciplinary working group, through working sessions, investors, companies, and schools have not provided complete records and documents as required; have not fulfilled their commitments to the Department of Education and Training of Ho Chi Minh City.
The legal entity that owns AISVN International School is American International Education Joint Stock Company, which was separated from Knowledge Resource Management Joint Stock Company. However, after completing the procedures to obtain a Certificate of Business Registration for the separated company, American International Education Joint Stock Company has not completed the necessary procedures as prescribed by the Investment Law and the Land Law to update and supplement information in the Investment Certificates (updating investors, supplementing project implementation objectives, etc.); Certificates of land use rights, house ownership rights and other assets attached to land (updating land users) have been issued to match the actual operations of the company.
Currently, AISVN International School is being built on land owned by Knowledge Resource Management Joint Stock Company.
Regarding the implementation of the provisions of the Investment Law, the Department of Planning and Investment has issued a document requesting investors to report to identify violations for advice on handling according to regulations. Regarding the implementation of land procedures for the construction land plot currently under the use of Knowledge Resource Management Joint Stock Company, the Department of Education and Training and related departments and branches are developing a feasible plan to request the transfer of land use rights to the American International Education Joint Stock Company. The fact that the legal entity owning AISVN International School does not own land use rights makes it difficult to call on investors to restructure and handle debt.
According to the assessment of parents and professional agencies, AISVN International School has a good training model and program, meeting the learning needs according to International Baccalaureate (IB) standards of students in the city and provinces in the region.
With such training quality, some investors have worked with Ms. Nguyen Thi Ut Em to propose financial support for the school to continue operating until the end of the 2023-2024 school year. However, the investors want to receive benefits in return in proportion to the company's shares and have the right to manage the school's financial activities.
AISVN International School students have to study by themselves in the swimming pool and canteen when teachers do not come to school because they have not been paid.
Suspend enrollment in the 2024-2025 school year until the investor completely resolves the issues
Ho Chi Minh City People's Committee also reported to the Ministry of Education and Training on directions and solutions for the coming time.
Specifically, relevant departments, branches and the People's Committees of districts, towns and Thu Duc City support the education sector to stabilize public opinion and strictly manage the activities of the American International Education Joint Stock Company because the company's activities directly affect the activities and educational quality of AISVN International School. Coordinate to monitor the school's operations, speed up the working progress with Ms. Nguyen Thi Ut Em to thoroughly resolve issues related to investment and organization of educational activities of the school; promptly handle arising cases and report to the Standing Committee of the City People's Committee for direction.
Quickly deploy solutions to ensure students' learning rights, not to interrupt their learning, such as directing the Department of Education and Training to work with public educational institutions and investors, foreign-invested schools, and schools that organize the International Baccalaureate (IB) program to accept transfer students according to their needs, creating conditions for students to quickly integrate and stabilize their studies.
Currently, there are 7 educational institutions that have agreed to accept students from AISVN International School, including: Australian International School, European International School, Ho Chi Minh City International School, English-speaking International School, British Vietnamese International School, North American School, and American International School (TAS). The above educational institutions can accept 1,088 students.
The Ho Chi Minh City People's Committee is assigning the Department of Education and Training to continue working with educational institutions and soon report on the plan to increase teachers to teach the International Baccalaureate (IB) program for the above students when they transfer to new schools.
Assign the Department of Education and Training to base on regulations to suspend enrollment in the 2024-2025 school year for AISVN International School until the investor resolves financial and personnel issues and stabilizes the organization of educational activities. Suspend the operation of AISVN International School if financial and personnel issues cannot be resolved according to regulations.
The City Police will coordinate with localities to grasp the social situation to have appropriate handling plans; strictly manage issues related to the entry and exit of personnel who are investors and the Board of Directors of AISVN International School until the case is completely resolved.
Assign the City Inspectorate to conduct a comprehensive inspection of American International Education Joint Stock Company and AISVN International School to clearly and fully identify related issues and take handling measures according to regulations.
