On October 23, 2023, Thanh Hoa Provincial People's Committee issued Decision No. 3907/QD-UBND on continuing to extend the time for completing land allocation and land lease dossiers to implement the Universal Incarnation - Phuc Lac Vien Expansion Project.

Accordingly, the project has an extension of the time to complete the above procedures until March 31, 2024. During the extension period or if the project has been leased land by the State, the competent State agency is responsible for continuing to review other documents and procedures for appraisal and approval in accordance with the provisions of relevant specialized laws.

The document also requires Hop Luc Joint Stock Corporation to urgently complete documents and procedures to soon start construction, complete and put phase 2 of the project into operation, ensuring the schedule, approved investment policy contents and related regulations; construction may only be started after completing all documents and procedures according to the provisions of law; and implement the periodic reporting regime according to the provisions of Article 72 of the Investment Law 2020.

The Department of Natural Resources and Environment shall guide Hop Luc Joint Stock Corporation in carrying out the dossiers and procedures for land allocation, land lease, and land use purpose conversion according to regulations. In the process of processing the dossiers and procedures for land lease and land use purpose conversion, if it is discovered that the land lease to Hop Luc Joint Stock Corporation without auction or bidding does not comply with current land laws, it must promptly report to the Provincial People's Committee for consideration, as a basis for handling the contents related to the investment policy according to regulations.

Assign Thanh Hoa City People's Committee to closely coordinate with Hop Luc Joint Stock Corporation to speed up the progress of compensation and site clearance to hand over the site to Hop Luc Joint Stock Corporation to implement phase 2 of the Universal Incarnation - Phuc Lac Vien expansion project in Quang Thanh ward and Quang Dong ward, Thanh Hoa city, as a basis for the unit to prepare land allocation and lease documents to ensure the above-mentioned extension period.

The Departments of Planning and Investment, Construction, Natural Resources and Environment, Thanh Hoa City People's Committee and related units are fully responsible before the law, the Provincial People's Committee, the Chairman of the Provincial People's Committee, inspection, examination and auditing agencies and related agencies for the accuracy and suitability of the contents of consultation, appraisal, and comments and the conditions as prescribed (including the contents under the functions and tasks of the units, related to the above project but not mentioned in the documents of consultation, appraisal and comments); at the same time, according to the assigned functions and tasks, are responsible for guiding, supporting and promptly resolving the work related to the above project as prescribed by law.

Completion of enforcement and site clearance

According to Nguoi Dua Tin's research, the expansion project of Dai Hoa Than Hoan Vu - Phuc Lac Vien (investor is Hop Luc Joint Stock Corporation) was approved for investment by Thanh Hoa Provincial People's Committee on January 7, 2020.

The project is implemented on an area of ​​over 14 hectares, in Quang Thanh ward and Quang Dong commune, Thanh Hoa city. The total investment of the project is over 83 billion VND, expected to be completed and put into operation in the third quarter of 2022.

On October 26, 2021, Thanh Hoa City People's Committee issued Decision 10497/QD-UBND to establish a Compensation, Support and Resettlement Council to implement the expansion project of the Universal Incarnation - Phuc Lac Vien.

Next, Thanh Hoa City People's Committee issued Decision No. 12415/QD-UBND on approving the land acquisition plan and resettlement support for this project.

Accordingly, the land acquisition location is in Quang Thanh ward and Quang Dong ward, the total land acquisition area is: 14.49 ha, of which Quang Thanh ward is 12.65 ha, Quang Dong ward is 1.84 ha.

Regarding compensation costs, the estimated GPMB support is more than 68 billion VND, including capital from Hop Luc Joint Stock Company and other legally mobilized sources.

The investment goal in expanding the Universal Crematorium - Phuc Lac Vien is to build a green, clean, beautiful cemetery park with synchronous technical infrastructure... in accordance with local customs and practices, ensuring environmental hygiene, and landscape architecture in harmony with nature.

It is expected that about 20,000 graves will be formed on a 10-hectare area at the Universal Cremation Temple - Phuc Lac Vien expansion project of Hop Luc Joint Stock Company.

According to Nguoi Dua Tin, Thanh Hoa city has so far enforced and completed the project's site clearance. However, some households are still concerned and objecting, saying that the land compensation plan is not satisfactory. They believe that the land acquisition for the expansion of this project is a case where the enterprise must negotiate with the people whose agricultural land is acquired, because this is a project invested by the private sector. At the same time, the project has the risk of polluting the environment in urban areas, affecting people's lives.

However, some other residents believe that the project's location in Thanh Hoa city, the "capital" of Thanh Hoa province, will make it more convenient for people to perform spiritual rituals without having to travel far.

"The expansion also ensures the general development trend of the demand for "cremation", the project is located in the city area, which also helps people move more conveniently", said Mr. Nguyen Huu Cuong, a resident of Sam Son City.

Explaining the above-mentioned issues that people are concerned about, in a document responding to citizens, Thanh Hoa City People's Committee stated that the project has been thoroughly researched and consulted by local authorities at all levels, and implemented in accordance with legal regulations.

Accordingly, the project to expand the Phuc Lac Vien Universal Crematorium was approved by the Chairman of Thanh Hoa Provincial People's Committee under the investment policy decision No. 53/QD-UBND dated November 1, 2020 with the investment goal: Building a clean, green cemetery park with synchronous technical infrastructure...

Therefore, based on Point c, Clause 3, Article 62, Land Law 2013, the above project was approved by the Provincial People's Council, so the State will carry out land recovery, not subject to the enterprise having to negotiate on its own as people reflect.

Next, regarding people's concerns about the project's risk of causing environmental pollution to households with surrounding residential land, Thanh Hoa City People's Committee stated that the project was approved by Thanh Hoa Provincial People's Committee for environmental impact assessment in Decision 130/QD-UBND dated January 7, 2022, Hop Luc Joint Stock Company is seriously responsible for the contents according to the decision. At the same time, the decision is the basis for competent state agencies to inspect, supervise and monitor the implementation of environmental sanitation of the project.

Also according to Nguoi Dua Tin's research, in August 2021, the People's Committee of Thanh Hoa province issued Decision No. 2972/QD-UBND approving the policy of adjusting the expansion project of Dai hoa than hoan vu - Phuc Lac Vien. Accordingly, the project has a land use area of ​​more than 18.4 hectares, the total investment of the project increased to more than 218 billion VND. The scale of the project includes a cemetery management area of ​​more than 18,000m2; isolated green land of more than 51,000m2. Notably, in this adjustment, the burial area has an area of ​​more than 100,000m2, with a burial capacity of about 20,000 graves.
