Consider passing the revised Land Law project next week

National Assembly Chairman Vuong Dinh Hue said the revised Land Law project has been basically completed and will be submitted to the National Assembly for comments and approval at an extraordinary session next week.

Speaking at the opening session of the National Assembly Standing Committee on the afternoon of January 8, National Assembly Chairman Vuong Dinh Hue asked delegates to focus on three major issues in the draft to continue completing the dossier, submit it to the National Assembly for comments and approval at the extraordinary session opening on January 15.

One is land acquisition for commercial housing projects, mixed commercial housing and service projects. Two is land valuation method, authority, responsibility for selecting land valuation method. Third is land fund creation project, land development fund, land use conversion.

According to Mr. Vuong Dinh Hue, this is a very important bill, with profound impacts on all aspects of the economy, society, people, and business community in the short and long term. The drafting and reviewing agency has prepared very carefully and elaborately, consulted experts and scientists many times, and organized a public consultation with 12 million comments.

The National Assembly Standing Committee also gave official comments five times. The Chairman and Vice Chairmen of the National Assembly, along with the Prime Minister and Deputy Prime Ministers, also had many working sessions with agencies on various contents of the draft. "Up to now, the draft law has basically been completed, institutionalized, and covers the spirit of Resolution 18 of the Central Committee, the Constitution, and the Party Platform," said Mr. Hue.

Previously, on the morning of November 22, 2023, the National Assembly agreed to adjust the time for passing the revised Land Law from the 6th session to the nearest session. At that time, the bill had 14 issues with two options for asking for the National Assembly's opinion. Of which, the issue that received the most comments from experts and National Assembly deputies and had to be continuously revised through the drafts was the State's land recovery (Articles 79, 126 and 128).

The draft submitted to the National Assembly at the 6th session designed two options for commercial housing projects and mixed housing, commercial and service projects. One is to stipulate that these projects are subject to the State's land acquisition for auction of land use rights and bidding to select investors. The second is that the projects must be attached with specific criteria and conditions in cases where the State acquires land for socio-economic development for national and public interests.

In the resolution of the legal session on January 5, 2024, the Government requested the Ministry of Natural Resources and Environment to design regulations on the transfer of land for commercial housing construction in the direction of self-negotiation between people and businesses, ensuring compliance with Resolution 18 of the Central Committee and reality.

The Government also requested the Ministry of Natural Resources and Environment to clearly stipulate in the draft revised Land Law the method of determining land prices; cases and conditions for applying valuation methods. The Government will specify in detail the content of land valuation, ensuring clarity, publicity, transparency, and harmony of interests of the State, land users and investors.

The extraordinary session of the 15th National Assembly is scheduled to last three days, opening on January 15 and divided into two sessions. The agencies designed the first session (from January 15 to the morning of January 17) for delegates to listen to presentations, reports, and discuss the draft laws on Credit Institutions (amended), Land (amended); Resolution on specific mechanisms and policies to remove obstacles, speed up the implementation of National Target Programs; National Marine Spatial Planning. The second session on January 19, 2024 to pass laws, resolutions, and close the session.
