The Ministry of Transport is finalizing amendments and supplements to Circular No. 16/2021/TT-BGTVT in a simplified manner to allow automatic extension of the inspection cycle according to Circular 02/2023/TT-BGTVT for passenger cars with up to 9 seats that are not used for transportation business. This Circular is expected to be issued by the Ministry of Transport this June.
This is the content of the report of Minister of Transport Nguyen Van Thang sent to National Assembly Deputies on a number of contents related to the group of questions at the 5th Session of the 15th National Assembly.
In the report, the Ministry of Transport admitted that the causes of violations in the field of motor vehicle inspection were due to the slow innovation of the organizational structure of the Vietnam Register, the lack of clear separation of state management functions and public service provision; the violations of some registration officers were very sophisticated and closed in some departments of the department, making them very difficult to detect compared to the authority and expertise of the functional forces of the transport sector.

When the Planning Law came into effect, the planning of the inspection center network was abolished, leading to a rapid increase in motor vehicle inspection units in some localities and urban areas, creating fierce and unhealthy competition.
To attract customers, some units have violated standards, regulations, and rules, omitted inspection contents and items, and committed fraudulent acts in motor vehicle inspection.
On the other hand, the inspection price was established 10 years ago and has not been adjusted appropriately in the context of increased input costs, causing difficulties for inspection centers and revenue not reaching expectations. The desire to recover capital quickly has led to unfair competition among inspection centers, violating legal regulations.
To allow violations in the field of motor vehicle inspection to occur, the Ministry of Transport said that the primary responsibility for state management belongs to the Vietnam Register. The Department of Transport of provinces and cities must also be responsible for inspecting and supervising inspection activities in the area.
On the side of the Ministry of Transport, in the report sent to the National Assembly Deputies, the Ministry acknowledged its responsibility for not being resolute in directing the adjustment, supplementation, and completion of legal regulations related to vehicle inspection activities, and not clearly separating the state management function and public service provision of the Vietnam Register.
According to Minister Nguyen Van Thang, in order to promptly rectify and overcome shortcomings and inadequacies in the field of vehicle registration, the Ministry of Transport is focusing on directing and implementing a review of the entire system of legal documents to promptly amend and supplement them to suit the reality in the direction of separating the state management function and service provision of the Vietnam Register, decentralizing and delegating maximum authority to localities associated with strengthening inspection, examination, and preventing negativity and waste.
In addition, the inspection units of the armed forces, genuine warranty and maintenance units are provided with vehicle inspection services; improving quality, ensuring healthy competition between inspection centers.
The Ministry of Transport shall review regulations related to prices of technical safety and environmental protection inspection services, fees and charges for motor vehicles to propose appropriate amendments and supplements, ensuring adequate compensation for inspection costs, contributing to limiting negative impacts in motor vehicle inspection work.
The Ministry of Transport is also urgently implementing the Decree amending and supplementing a number of articles of Decree No. 139/2018/ND-CP dated October 8, 2018 of the Government regulating the business of motor vehicle inspection services immediately after it is issued by the Government (expected in early June 2023); amending and supplementing Circular No. 16/2021/TT-BGTVT in a simplified order to allow automatic extension of the inspection cycle according to Circular 02/2023/TT-BGTVT for passenger cars with up to 9 seats not used for transportation business (expected to be issued in early June 2023).
Since October 2022, law enforcement agencies have searched and prosecuted and detained nearly 600 leaders and inspectors. To date, the total number of inspection units operating is 249/281 units, while 32 units are not yet qualified to resume operations.
In Hanoi, there are currently 26/31 inspection units operating, meeting only 51% of the inspection demand and in Ho Chi Minh City, there are 16/19 inspection units operating but only meeting 52% of the demand of people and businesses due to the number of vehicles being congested and overdue for inspection accumulated over the past several months...
