The Ministry of Agriculture and Environment recently submitted to the Ministry of Justice a draft Decree detailing the implementation of the National Assembly's Resolution on piloting commercial housing projects through agreements to receive land use rights or those who currently have land use rights.

This is an important step in removing obstacles and promoting the implementation of commercial housing projects, helping to meet the housing demand in the current market context of severe shortage.

This draft Decree is not only an opportunity for real estate businesses to remove difficulties in investment procedures but also an effective solution to help increase the supply of commercial housing for the market.

One of the notable points of the Draft Decree is the process of implementing investment and construction procedures for real estate business organizations.

According to Article 7 of the Draft, real estate business organizations that have land use rights, or after completing the agreement to receive land use rights, will be allowed to continue carrying out necessary procedures such as approving investment policies and selecting investors.

In particular, for projects that have been permitted by the State to be implemented before Resolution No. 171/2024/QH15 takes effect, investment-related procedures do not need to be redone.

Investors only need to continue carrying out land procedures, helping to save time, costs and quickly implement the project.

This policy will help solve the current shortage of commercial housing, while promoting socio-economic development and minimizing waste of business and social resources.

Article 8 of the Draft Decree clearly stipulates procedures related to land when implementing pilot projects.

Procedures such as land recovery, land allocation, land use purpose conversion, land registration, and issuance of Land Use Right Certificates will be carried out in accordance with current laws.

In addition, a notable point is that in the case of projects that have to relocate production facilities due to environmental pollution or according to urban planning, and if the land for implementing the project has not been granted a Certificate of Land Use Rights, the real estate business organization will be allowed to carry out the registration procedure for granting the Certificate at the same time as changing the land use purpose.

This not only helps reform administrative procedures but also solves difficulties for projects that need to be relocated due to environmental pollution or urban planning, while promoting the rapid development of commercial housing projects.

Another highlight of the Draft is the determination of financial obligations regarding land for pilot projects. Accordingly, real estate business organizations must fulfill financial obligations regarding land according to the provisions of Chapter XI of the Land Law and related decrees.

However, for projects organized and implemented by the Ministry of National Defense and the Ministry of Public Security and having fulfilled financial obligations before the effective date of Resolution No. 171/2024/QH15, reasonable expenses will be confirmed by the Ministry of National Defense and the Ministry of Public Security and deducted from financial obligations.

This is especially important for projects to relocate military or manufacturing facilities out of polluted or unplanned areas.

Confirming and deducting these costs will help reduce the financial burden on investors, while ensuring fairness in the implementation of these projects.

This draft Decree is not only an opportunity for real estate businesses to remove difficulties in investment procedures but also an effective solution to help increase the supply of commercial housing for the market.

In the context of housing supply still being a difficult problem, the regulations in the Draft promise to create a big boost for the real estate industry, promote the development of housing projects, meet people's needs, and at the same time contribute to the sustainable development of the economy.

By cutting down on administrative procedures, minimizing waste of resources, and creating favorable conditions for investors, this Draft Decree is an important step in administrative reform, promoting the strong development of the real estate market, while ensuring transparency and fairness in the implementation of commercial housing projects.
