Prime Minister Pham Minh Chinh chairs the Government's special meeting on law making in November 2023

Attending the meeting were: Deputy Prime Minister Tran Hong Ha; Ministers, Heads of ministerial-level agencies, Government agencies; leaders of ministries, branches and central agencies.

Opening the meeting, Prime Minister Pham Minh Chinh emphasized that institutional building and improvement is one of the three strategic breakthroughs identified by the Party and State. The strategic breakthrough in institutional building and improvement is one of the key tasks, of fundamental significance, creating a legal framework to unblock, liberate, mobilize and effectively use all resources for rapid and sustainable socio-economic development.

Since the beginning of 2023, the Government and the Prime Minister have continued to pay special attention and invest in this work, especially in reviewing and perfecting laws, removing bottlenecks, difficulties and obstacles, and creating favorable conditions for people and businesses. The Government has organized 8 thematic meetings on law-making; and is submitting to the National Assembly for consideration and approval many important draft laws that have a profound impact on the entire socio-economic life. Along with that, the Government and the Prime Minister have issued 100 legal documents.

According to the Prime Minister, the law-making process always ensures the following requirements: Strengthening discipline, ensuring progress and quality of building and submitting normative documents; minimizing administrative procedures, reducing "asking - giving", reducing harassment, reducing compliance costs for people and businesses; handling newly arising issues to mobilize maximum resources for development; thoroughly decentralizing and delegating power, promoting the role of the leader, associated with appropriate resource allocation, enhancing the implementation capacity of subordinates, strengthening supervision, inspection and control of power; not allowing group and local interests, the interests of ministries, branches and localities to be inserted in law-making.

“The Ministry of Justice and the Government Office must review and if any ministry or agency has not assigned a Minister, Head of a ministerial-level agency, or Government agency to be in charge of institutional development and completion, it must be assigned immediately and completed in November 2023 to focus on leading and directing institutional development and completion, in the spirit of “what is said must be done, what is resolved must be implemented”, the Prime Minister reminded.

The Prime Minister frankly stated that the work of building and perfecting institutions still has shortcomings and limitations. The submission of a number of projects and drafts of normative documents is still slow, and the quality is not guaranteed. The situation of slowness and backlog in issuing detailed regulations has not been thoroughly resolved; policy responses in some places and at some times have not been timely; discipline and order in some places and at some times have not been strict...

“These are also issues that National Assembly deputies, compatriots, and voters are particularly interested in; they need to be paid close attention to and promptly resolved. Issues that are clear, mature, proven to be correct in practice, effectively implemented, and agreed upon by the majority should continue to be implemented; issues that do not have regulations or exceed regulations must have regulations developed to create a legal corridor for development,” the Prime Minister noted.

At the meeting, the Government listened to the presiding agency briefly present the proposal for drafting the Laws; report on explanations and acceptance of opinions on drafting the Laws; synthesize opinions of ministries and branches; consider the preparation process and procedures; requirements and principles for drafting the Laws; consistency and consistency with relevant legal provisions; refer to international experience; and at the same time deeply analyze fundamental issues and there are many different opinions in the draft Laws.
