Kinhtedothi - On the afternoon of November 20, continuing the 8th Session, the National Assembly worked in the hall to listen to reports on the Draft Law amending and supplementing a number of articles of the Law on Supervisory Activities of the National Assembly and People's Councils.
Presenting the report on the Draft Law amending and supplementing a number of articles of the Law on Supervision Activities of the National Assembly and People's Councils, Chairman of the National Assembly's Ethnic Council Y Thanh Ha Nie Kdam - Head of the Drafting Committee said: The Draft Law consists of 3 articles, closely following the 5 policies submitted to the National Assembly in the dossier proposing the drafting of the Law.
Of which, 77 clauses of 43 articles were amended and supplemented, 8 new articles were added and 1 clause of the Law on Supervisory Activities of the National Assembly and People's Councils was abolished; and a number of articles of related laws were amended and supplemented.
At the same time, the Draft Law adds 3 articles regulating: reviewing the implementation of resolutions of the National Assembly and the National Assembly Standing Committee on questioning and thematic supervision in the form of questioning; the National Assembly delegation supervises the settlement of complaints, denunciations and recommendations of citizens.
Regarding the supervision of the People's Council, the Draft Law amends and supplements the provisions on the authority and responsibility of the People's Council, the People's Council's agencies, and People's Council delegates; criteria for selecting groups of questions to be questioned at the People's Council's session, at the People's Council Standing Committee's meeting, the supervision topics of the People's Council, the People's Council Standing Committee, the People's Council's Committees, the issues of explanation at the People's Council Standing Committee's meeting; methods, procedures, and time for carrying out supervision activities; taking votes of confidence and voting for those elected by the People's Council.
Add 2 articles regulating the review of the implementation of resolutions of the People's Council and the Standing Committee of the People's Council on questioning and thematic supervision in the form of questioning.
Regarding ensuring supervision activities, the Draft Law amends and supplements the provisions in 3 clauses of 2 articles on ensuring the implementation of supervision activities; the implementation of supervision conclusions and recommendations. At the same time, 2 articles are added to regulate the provision, sharing, exchange, processing, and use of information serving supervision activities and the application of information technology and digitalization in the supervision activities of the National Assembly and People's Councils...
Presenting the review report, Chairman of the National Assembly's Law Committee Hoang Thanh Tung said that the Law Committee agreed with the need to amend and supplement a number of articles of the Law on Supervisory Activities. The draft Law dossier was seriously prepared, basically ensuring full documentation according to the provisions of the Law on Promulgation of Legal Documents.
Regarding the viewpoint of law-making, the Law Committee emphasized a number of requirements that need to be thoroughly grasped and implemented synchronously in the process of building and promulgating the Law, such as: closely following the Party's policy on innovation, improving the effectiveness and efficiency of supervision activities; the content of amendments and supplements must be based on the results of summarizing practices, ensuring focus and key points, avoiding spreading or overlapping. Fully and seriously implementing solutions to innovate thinking in law-making, not legalizing contents that are not under the authority of the National Assembly, contents that need to be flexible to suit practical requirements...
Regarding some issues with different opinions, Chairman of the Law Committee Hoang Thanh Tung said that regarding the addition of new principles of supervision activities, the Law Committee has two types of opinions. The first type of opinion suggests considering the regulation of this content as a principle of supervision activities; the second type of opinion agrees with the addition of new principles as proposed in the Draft Law.
Regarding the regulation of the time for the National Assembly to review and discuss reports, many opinions in the Law Committee agreed with option 1 and said that regulating the time for the National Assembly to review and discuss at the mid-year session for a number of reports will help to reasonably regulate and reduce the already large workload of the National Assembly at the year-end sessions; create favorable conditions for the Government to fully synthesize the situation and data in 1 year, overcoming the situation where agencies have to collect data many times to serve the construction of reports to submit to the National Assembly, causing waste of resources.
Regarding the addition of the National Assembly's authority in reviewing the results of supervision, the majority of opinions in the Law Committee proposed not to add the provision that the National Assembly requires the Law Committee to issue documents explaining the Constitution, laws, and ordinances to be consistent with the provisions of the Law on Organization of the National Assembly and the Law on Promulgation of Legal Documents, which specifically stipulate the subjects with the right to request the Law Committee to explain the Constitution, laws, and ordinances and the order and procedures for explaining the Constitution, laws, and ordinances.
At the same time, it is proposed not to add a provision that the National Assembly requires the Government, the Prime Minister, and agencies to issue documents guiding laws, ordinances, and resolutions because this issue falls under the authority and proactive responsibility of agencies in organizing the implementation of the Constitution and laws, which has been specifically stipulated in the Law on Promulgation of Legal Documents and corresponding laws on organizational apparatus.
