Review and make a list of small, narrow, and interspersed land plots directly managed by the State.

This Decision takes effect from December 5, 2024 and replaces Decision No. 27, dated October 10, 2022 of the Provincial People's Committee promulgating the Regulations on reviewing and publicly announcing the list of small, narrow land plots directly managed by the State; collecting public opinions and publicizing the allocation and lease of land for small, narrow land plots in the locality for public use or allocation and lease to adjacent land users in Quang Nam province. Reviewing, collecting opinions and making a list of small, narrow, interspersed land plots directly managed by the State (Article 3) is a notable content in the specific provisions of this Decision. Accordingly:

1. Annually, the District People's Committee is responsible for directing the Commune People's Committee to preside over and coordinate with relevant agencies based on the criteria for small, narrow, and interspersed land plots prescribed in Clause 1, Article 47 of Decree 102, dated July 30, 2024 of the Government detailing the implementation of a number of articles of the Land Law, to review, make statistics, and make a list of small, narrow, and interspersed land plots managed by the State according to Form No. 01 attached to this regulation.

2. Organize, manage and use land funds; the unit in charge of compensation, support and resettlement shall review and make statistics on the remaining land fund after the State recovers land, compensates, supports, resettles, and hands over the site to implement works and projects (if any), and send them to the relevant commune-level People's Committee to compile into the list of small, narrow, and interspersed land plots in the locality.

3. Based on the review results in Clause 1 and Clause 2 of this Article, the People's Committee at the commune level is responsible for assigning the First Land Registration Council at the commune level as prescribed in Point c, Clause 3, Article 20 of Decree No. 101, dated July 29, 2024 of the Government to confirm relevant contents as prescribed in Clause 1 and Clause 2, Article 33 of Decree No. 101, dated July 29, 2024 of the Government to compile a list of small, narrow, and interspersed land plots in the locality under management and assigning land and construction officials to coordinate with the branch of the land registration office to conduct measurements and determine the location and area of ​​each land plot.

4. The People's Committee of the commune where the land is located shall post and publicly announce the list of small, narrow, and interspersed land plots managed by the State according to Form No. 02 attached to this Regulation at the headquarters of the People's Committee of the commune and the common meeting point of the residential area where the land is located and announce the list on the commune-level radio for people where the land is located to give their opinions. The time for posting and public announcement shall be 15 consecutive days. After completing the public announcement and collecting opinions, the People's Committee of the commune where the land is located shall be responsible for responding to the opinions (if any) in writing and synthesizing the list, accompanying documents, and reporting to the People's Committee of the district and the Department of Natural Resources and Environment.
