Quang Nam increases maximum support for people whose land is recovered

Accordingly, the Regulations on compensation, support and resettlement when the State acquires land in the province include 5 chapters, 26 articles with many new regulations according to the 2024 Land Law. Notably, Article 4 (Compensation with land with a different purpose than the type of land acquired when the State acquires land as prescribed in Clause 3, Article 4 of Decree No. 88/2024/ND-CP).

According to regulations, cases of compensation with land with a different purpose of use than the type of recovered land according to Article 4 are carried out when the person whose land is recovered does not need compensation with land with the same purpose of use as the type of recovered land or compensation in cash for the recovered land area and in the district, town, or city there is a residential land fund to ensure compensation according to regulations.

This regulation is said to open up opportunities to choose compensation options for people whose agricultural land is recovered, especially the opportunity to be arranged for resettlement land.

In addition, the Regulations on compensation, support and resettlement when the State acquires land in the province are also considered to increase the maximum support level for people whose land is acquired, especially compensation for damage to houses and other construction works attached to the land; compensation and support due to the relocation of graves; compensation for the cost of moving assets; especially the regulations on supporting the stabilization of life when the State acquires land...

This Decision takes effect from November 10, 2024 and replaces Decision No. 42/2021/QD-UBND dated December 21, 2021 of the Provincial People's Committee promulgating Regulations on compensation, support, and resettlement when the State acquires land in Quang Nam province; Decision No. 18/2022/QD-UBND dated June 20, 2022 of the Provincial People's Committee regulating other support when the State acquires garden and pond land in the same plot of land with a house but not recognized as residential land in Quang Nam province; Decision No. 29/2022/QD-UBND dated October 20, 2022 of the Provincial People's Committee amending and supplementing a number of articles of the Regulations on compensation, support and resettlement when the State acquires land in Quang Nam province, issued together with Decision No. 42/2021/QD-UBND dated December 21, 2021 of the Provincial People's Committee.
