Or posting promotional videos with "doctors" and "experts" in white coats comparing different types of milk, confusing the concept of milk with high frequency on social networks, causing confusion for consumers.
Expressing his views on this situation, Mr. Le Hoai Diep said that the Competition Law regulates many groups of behaviors, including a group of prohibited unfair competition behaviors. According to the provisions of Article 45 of the Competition Law 2018, unfair competition behaviors are prohibited, including the following related behaviors:
Firstly, providing dishonest information about another enterprise by directly or indirectly providing dishonest information about the enterprise that adversely affects the reputation, financial status or business operations of that enterprise.
Second, illegally luring customers by means such as providing false or misleading information to customers about the enterprise or the goods, services, promotions, and transaction conditions related to the goods and services provided by the enterprise in order to attract customers of other enterprises; comparing one's own goods and services with the same type of goods and services of other enterprises but failing to prove the content.
Nowadays, social networks have become popular among users in Vietnam. Posting news, articles, statuses, or sharing and commenting on personal pages has become easy.
Much of the content has been censored, but much of the information remains unverified and uncensored.
Therefore, according to Mr. Le Hoai Diep, businesses or individuals when providing information to consumers or advertising their products and services need to pay attention to avoid violating competition law and other relevant legal regulations.
“Not only in the dairy sector but in any sector, unfair competition has negative impacts on the market, on honest businesses and on consumers.
Providing incorrect information about a product, service, or business can affect consumers' perception of that product, service, or business.
"Entities participating in unfair competition that affect the legitimate rights and interests of other businesses, the rights and interests of consumers, and the business environment, whether intentionally or unintentionally, can be handled according to the law," said Mr. Le Hoai Diep.
The National Competition Commission will coordinate with other State management agencies in monitoring and reviewing signs of violations. In case of detecting violations, the National Competition Commission will coordinate with other State management agencies to handle violations or initiate an investigation and handle them according to the provisions of the law on competition.
At the same time, the National Competition Commission recommends that businesses, especially dairy businesses, need to develop a policy of compliance with legal regulations to ensure compliance with competition laws and other relevant legal regulations.
