New regulations on the establishment and appraisal of public investment projects

The Minister of Planning and Investment has just signed and issued Circular No. 19/2024/TT-BKHDT regulating the preparation, appraisal, assignment, adjustment, monitoring, and evaluation of plans, programs, tasks, and public investment projects on the National Information System and Database on Public Investment.

Accordingly, the scope of regulation of the Circular includes the establishment, appraisal, assignment, adjustment, monitoring, and evaluation of medium-term and annual public investment plans using central budget capital, local budget capital, and capital from legal revenue sources of state agencies and public service units for investment.

At the same time, monitor and evaluate public investment plans using reserve funds, increased revenue, expenditure savings, surpluses and other sources of state budget capital for development investment expenditure. Manage information, data, monitor and evaluate programs, tasks, projects and other public investment objects using public investment capital on the System.

The Circular applies to agencies, units, organizations and individuals participating in or related to the preparation, appraisal, assignment, adjustment, monitoring and evaluation of plans, programs, tasks, projects and other public investment objects on the System within the scope of regulation specified in Article 1 of the Circular. Other programs, tasks, projects and public investment objects that require state secrets according to the law on state secret protection are not subject to Circular 19.

Regarding account issuance, authorization and authentication of information and data, based on the account registration proposal of ministries, central and local agencies, the Ministry of Planning and Investment issues accounts and authorizes according to the registered request. Proposals, submissions, approvals and reports of information and data on the System will be based on the authorization of registered accounts and must be authenticated by the digital signature of the account manager according to the System's process.

The Circular clearly stipulates the preparation, appraisal, assignment and adjustment of medium-term and annual public investment plans on the System; reporting on the implementation of public investment plans, programs and projects on the System; sharing and synchronizing data and publicizing information on the disbursement status of public investment plans from the state budget.

The Ministry of Planning and Investment is responsible for organizing the construction, management and implementation of the National Information System and Database on Public Investment. Based on the provisions of the law on public investment, the Ministry of Planning and Investment develops principles, criteria, information fields, data, and reporting forms on the System to synthesize, review, and evaluate information and data entered into the System.

At the same time, synthesize, review, and monitor programs, tasks, projects, other public investment objects, and public investment plans of ministries, central agencies, and localities on the System to report to competent authorities as prescribed. Guide and urge relevant agencies and organizations to update and report as prescribed in this Circular. At the same time, preside over training and guidance on the management, operation, and exploitation of the System nationwide.

The Circular clearly states that ministries, central and local agencies are responsible for entering and updating information and data in accordance with the procedures and requirements on the System; using and exploiting information according to the decentralization on the System in the work of synthesizing and monitoring the implementation of medium-term and annual public investment plans at ministries, central and local agencies...

Along with that, investors, component project owners, and program owners are responsible for timely and accurate updating of information and reports according to the provisions of the Circular; at the same time, they are responsible for the information and data entered on the System and are responsible according to the provisions of law for reporting and providing inaccurate information on the investment implementation status within the scope of management.

The Circular takes effect in the preparation, appraisal, adjustment, monitoring and evaluation of plans, programs, tasks and public investment projects on the National Information System and Database on Public Investment from the 2025 public investment plan for central budget capital and from the medium-term public investment plan for the period 2026 - 2030 for public investment capital according to the provisions of the Law on Public Investment.
