
This Decision applies to agencies, organizations and individuals involved in the use of state budget, official development assistance (ODA) capital, and preferential loans from foreign donors to organize groundbreaking ceremonies, commencement ceremonies and inauguration ceremonies of works.
Conditions for organizing groundbreaking ceremonies, commencement ceremonies and inauguration ceremonies of projects
The groundbreaking ceremony is held when: The investor or the agency or organization assigned to prepare the project (hereinafter referred to as the investor) is handed over the site by the competent authority or handed over the site in stages and the project has been approved in accordance with the authority and regulations.
The groundbreaking ceremony is held when the requirements for groundbreaking conditions are met as prescribed in Clause 1, Article 107 of the Law on Construction, amended and supplemented in Clause 39, Article 1, Law No. 62/2020/QH14.
The inauguration ceremony is held after the project has been inspected and accepted by a competent state agency and meets the requirements according to regulations.
The project held a groundbreaking ceremony or groundbreaking ceremony and a construction inauguration ceremony.
Authority to decide on the organization of ceremonies
The Prime Minister decides to organize ceremonies for important national works which are main works belonging to important national projects according to the provisions of the Law on Public Investment based on the proposal of competent state agencies or investors.
The head of a ministry or central agency shall preside over and coordinate with the Chairman of the provincial People's Committee to decide on the organization of ceremonies for projects that he/she decides to invest in, such as projects of great value, of important economic, political, cultural and social significance to the locality, which are key projects belonging to Group A projects according to the provisions of the Law on Public Investment and of important economic, political, cultural and social significance to the locality.
The Chairman of the Provincial People's Committee decides to organize ceremonies for projects that he/she decides to invest in, such as projects of great value, of important economic, political, cultural and social significance to the locality, which are main projects belonging to Group A projects according to the provisions of the Law on Public Investment and of important economic, political, cultural and social significance to the locality.
The investor shall make a plan to organize the ceremony, clearly stating: Content, time, location, composition, cost, implementation plan; submit it to the competent authority for decision.
The investor shall not require the contractor to pay for the organization of the ceremonies.
The decision stipulates that the cost of organizing the ceremony is included in the total investment of the project.
Based on the permission to organize the ceremony from the competent authority, the investor shall prepare and approve the cost estimate for each ceremony. The cost estimate for organizing the ceremony shall be prepared in accordance with the content and scale of the project, according to the current norms, standards and regulations of the State. The investor shall not request the contractor to pay for the cost of organizing the ceremonies.
