District 1: Strictly prohibit taking advantage of the name of the parents' representative board to collect fees outside of regulations.

The People's Committee of District 1 has just issued an official dispatch requesting to strengthen the management of revenues in the field of education and training, fundraising activities for education and operating expenses of the Parents' Representative Board for the 2024-2025 school year.

Accordingly, the People's Committee of District 1 requested principals of kindergartens, primary schools, secondary schools and affiliated units to strengthen information, propaganda, dissemination and popularization of documents guiding the implementation of revenue and expenditure to educational institutions.

At the same time, schools need to disseminate and propagate to parents, parent representatives, and teachers to clearly understand and comply with regulations on revenues and expenditures for the 2024-2025 school year as well as tuition exemption and reduction policies and support for learning costs.

In particular, all revenues must be fully and publicly announced in writing to parents and students by the unit (clearly stating the contents of revenues from services serving and supporting educational activities according to Resolution No. 13/2024/NQ-HDND and revenues from organizing other educational activities according to regulations); extending the time for implementing revenues, not organizing multiple collections at the same time, and fully implementing financial management regimes according to regulations.

The school did not allow any violations or incomplete implementation of regulations to occur, creating negative public opinion towards the education sector.

The leaders of District 1 People's Committee also requested that educational institutions must publicly make commitments to fully provide quality education and training, facilities, tuition fees, other fees, methods and implementation time according to regulations.

In particular, the document clearly states: "It is strictly forbidden to take advantage of the name of the parent-teacher association to collect fees other than those prescribed in Circular No. 55/2011/TT-BGDDT dated November 22, 2011 of the Ministry of Education and Training."

District 1 People's Committee requests educational institutions to note that the operating budget of the parent-teacher association is managed and used by the parent-teacher association and only serves the direct activities of the parent-teacher association.

The funds of the parents' representative committee shall not be used for the following purposes: "Protecting school facilities, ensuring school security; supervising students' means of transportation; cleaning classrooms and schools; rewarding school administrators, teachers and staff; purchasing machinery, equipment and teaching aids for schools, classes or for school administrators, teachers and staff; supporting management work, organizing teaching and learning and educational activities, repairing, upgrading and constructing new school facilities" (Point b, Clause 4, Article 10 of Circular 55).

The principal of the unit agrees with the head of the school's parents' representative committee to decide on the plan for using the school's parents' representative committee's funds and only uses them after the entire school's parents' representative committee has agreed (excluding sponsorship funds).

District 1 People's Committee assigned the Department of Education and Training to coordinate with the Department of Finance and Planning to propose a plan to periodically and suddenly inspect the revenue and expenditure situation at the beginning of the school year at educational institutions in the area; promptly correct the situation of overcharging or incomplete implementation of regulations; and take strict measures against principals of educational institutions that collect and spend money not in accordance with regulations.

Regarding the mobilization, reception, management and use of aid, sponsorship and gifts at educational institutions, the leaders of District 1 People's Committee requested that schools must comply with the provisions of Circular No. 16/2018/TT-BGDDT of the Ministry of Education and Training and Official Dispatch No. 1427/UBND-VX dated (April 17, 2019) of the Ho Chi Minh City People's Committee.

Accordingly, the mobilization plan must be approved by the Department of Education and Training before organizing the mobilization and must be voluntary, not imposed.

The content of the fundraising plan must clearly define the purpose, beneficiaries, implementation plan, and estimated implementation costs.

Schools encourage sponsors to organize investment and construction in the form of "turnkey", purchasing equipment and complete installation for handover to educational institutions.

The establishment and operation of the sponsorship receiving team must be fully implemented in accordance with Article 6 of Circular No. 16/2018/TT-BGDDT on the structure, composition, method of organization of reception and responsibility in receiving and using sponsorship, widely disseminating information about the sponsorship mobilization plan after being approved by competent authorities, providing information on time, location, name and account number of the unit receiving sponsorship.

Funding must be promptly consolidated into periodic financial revenue and expenditure settlement reports and annual financial settlement reports as prescribed.

Currently, according to the provisions of Clause 2, Article 15 of Circular No. 16/2018/TT-BGDDT, agencies, organizations, individuals and heads of educational institutions receiving funding who carry out the process of mobilizing, receiving, managing and using funding contrary to the regulations, depending on the level of violation, will be subject to administrative sanctions or criminal prosecution according to the provisions of law.
