Many violations and shortcomings were discovered in construction licensing in District 6.

According to the inspection conclusion, the People's Committee of District 6 has a plan to rearrange and handle the State management work but has not been proactive and timely in directing. Supervision and inspection work is not regular, and has been prolonged for many years. In addition, it has not monitored and urged units in the preparation, adjustment and approval of the Project, leading to ineffective exploitation of public houses and land.

The conclusion also clearly stated that public service units of District 6 People's Committee used assigned public houses and land for business purposes, leasing, joint ventures, and associations without project approval by competent authorities, which is not in accordance with regulations.

Regarding District 6 Public Service Company Limited (DVCI), the Ho Chi Minh City Inspectorate has determined that the company's application of short-term rental prices for real estate is not in accordance with the City People's Committee's direction on public property management. At the same time, the company has not submitted to District 6 People's Committee the process of managing and leasing public land and real estate for production and business purposes.

Many issues related to public land management and construction licensing have been pointed out by the Ho Chi Minh City Inspectorate in its inspection conclusion.

Meanwhile, many houses and lands are left vacant, not exploited effectively, showing signs of degradation, not ensuring environmental hygiene; there is no proactive solution to handle cases of having to reclaim rented houses and lands, causing waste.

DVCI Company has no plan and resolute solution to recover the debt of house and land rent, which may cause loss of revenue to the State budget. The company's signing of lease contracts for 10 small, surplus houses and land is a violation of regulations.

Similarly, the inspection conclusion also pointed out many violations in the management and use of public assets of the District 6 Cultural and Sports Center. This unit used houses and land that were not in accordance with the planning and not in accordance with the direction of the Ho Chi Minh City People's Committee, exploited for rent and negotiated rental prices without the project being approved. This is a violation of the regulations clearly stated in Decree 151/2017/ND-CP dated December 26, 2017 detailing a number of articles of the Law on Management and Use of Public Assets.

Regarding the state management of urban construction order, the Ho Chi Minh City Inspectorate also pointed out many shortcomings and problems. Specifically, there were 390 cases of construction permits being granted but the dossier components did not show the field inspection documents and the dossier processing control form showed incomplete time and signatures of the deliverer and receiver.

4 cases without a proposal for a construction permit and 3 cases without the signature of the person receiving the application. 5 construction items without a construction permit application or a registration application for renovation or repair at the Metro Cash & Carry Center land managed and used by MM Mega Market Company Limited.

Regarding the handling measures, the Ho Chi Minh City Inspectorate has recommended that the City People's Committee assign the District 6 People's Committee to check the accuracy and legality of the amount of revenue and expenditure in the leasing, joint ventures, and association of part of public houses and land of 37 public service units under its management. Handle expenditures that are not for the right purpose or to the wrong subjects, and recover and submit them to the State budget. At the same time, review and handle cases of houses and land used not in accordance with the approved arrangement plan.

Regarding DVCI Company, the Ho Chi Minh City People's Committee requested that this enterprise take measures to handle and remedy the short-term leasing of 35 houses and lands for production and business at market prices. Take measures to avoid waste with 33 houses and lands that are left empty; handle 6/153 houses and lands that must be recovered but are stuck due to procedures; and completely handle 10 surplus houses and lands that were signed for lease without approval from the Ho Chi Minh City People's Committee.

The Ho Chi Minh City People's Committee also assigned the Department of Home Affairs to preside over and coordinate with relevant units to organize a review of shortcomings and violations according to the above inspection conclusions. Depending on the nature and level, there will be appropriate and proper handling measures for relevant organizations and individuals according to the authority of cadre management.
