Seizing customer debt payment money

Based on the investigation results, before the Lunar New Year 2022, through an introduction, Nguyen Quoc Thanh (born in 1991, residing in Long Xuyen City) met Phuong (a credit officer of Vietnam Maritime Commercial Joint Stock Bank, An Giang Branch, abbreviated as MSB), so he contacted MSB to apply for a loan, the collateral being land use rights. After appraisal, Phuong informed Thanh that the bank had disbursed a loan of 1.27 billion VND. During this same period, Phuong owed money to many people, but was no longer able to pay and pay interest, so he had the idea of ​​appropriating Thanh's loan to pay off the debt.

Around the beginning of March 2022, Thanh and his wife went to MSB Bank to sign a loan application and were instructed by Phuong to install MSB Bank's electronic application and pin code. Wanting to appropriate Thanh's money, Phuong instructed Thanh and his wife to install the application and set the pin code. When Thanh and his wife finished signing the documents, the loan limit of 1 billion VND was disbursed to their payment account and 270,000,000 VND to Thanh's overdraft loan. Taking advantage of Thanh not knowing that the loan was disbursed through an MSB Bank account and not knowing how to perform transactions on the electronic application, Phuong used her phone to log into her bank account using Thanh's phone number and requested an OTP code to change the password, Soft Token code, transfer money from Thanh's payment account and overdraft account to Phuong's account and pay off the debt to the borrowers.

After that, Thanh contacted Phuong many times to ask about the loan amount, Phuong lied to Thanh that he was waiting for disbursement. After knowing that Phuong had deceived him, Thanh went to the Provincial Police Investigation Agency to report the incident. On August 28, 2024, Phuong was prosecuted and temporarily detained for investigation. During the investigation, Phuong's relatives handed over 400 million VND to remedy the consequences. After reviewing the related details, the Provincial People's Court sentenced the defendant Phuong to 11 years in prison for the crime of "Fraudulent appropriation of property". At the same time, the defendant was required to compensate the victim Thanh for the amount of money he had appropriated and interest as required by the bank so that Thanh could fulfill his obligations to MSB Bank.

Taking advantage of loopholes, employees embezzle money from their employers.

Having a job that was relatively suitable for her, Tran Thi Kim Cuong (born in 1987, residing in Quoc Thai commune, An Phu district) did not try to keep the job. On the contrary, because she wanted to have money to spend and use quickly, taking advantage of her employer's trust, Cuong committed wrongdoings in the process of collecting debts from customers and embezzling hundreds of millions of dong.

Around September 2020, Cuong was hired by Nguyen Thi Hong Tuyet and her husband to work as a sales consultant at Nguyen Canh Interior Decoration Store (Thanh Phu Hamlet, Khanh An Commune, An Phu District). However, after a few months of getting used to the job, Cuong had the idea of ​​taking the owner's money to spend. From around December 2020 to August 2021, taking advantage of the store's loose management of debt collection books, Cuong arbitrarily collected money from the sale of construction materials and interior decoration items from 27 customers and appropriated a total of over 650 million VND for personal use. After discovering the incident, Ms. Tuyet filed a complaint against Cuong's violations with the police. During the investigation, Cuong's relatives agreed to transfer the land use rights to Ms. Tuyet and her husband to deduct the amount of money Cuong had appropriated. On October 14, 2024, Cuong was indicted and detained for investigation. Through questioning and examination, at the end of the trial, the Trial Panel decided to sentence defendant Cuong to 8 years in prison for the crime of "Abuse of trust to appropriate property" under Clause 4, Article 175 of the Penal Code.

Through the cases, it is shown that because of the temptation of money, many individuals do not hesitate to use fraudulent tricks, taking advantage of the trust of honest people to commit crimes, and have to pay the wrong price with days and months in prison.
