On the morning of May 26, the National Assembly discussed in the hall a number of contents with different opinions in the draft revised Law on Consumer Rights Protection.

Commenting on some controversial contents of the bill, delegate Nguyen Van Canh proposed that the law should pay attention to protecting consumer rights when they are violated by other consumers.

Given that Vietnam is striving to become a civilized country, to achieve this, many factors such as cultural resources, human resources, and laws are needed. Of these, the two laws with the most direct impact are the Law on Road Traffic Safety and the Law on Consumer Rights Protection.

The reason is that in daily life, the most common activities are traveling, business, shopping, eating, and entertainment. Delegate Canh also said that in civilized Western countries, they respect individual rights. Or Japan considers not disturbing others as a cultural characteristic.

Meanwhile, many consumers are jostled by others when using services; dress and speak inappropriately; bring pets, and behave inappropriately.

“Perhaps everyone has encountered this problem many times regardless of gender, age, education level, position, or economic conditions. Many consumers think that business organizations and individuals must treat them as gods. But other consumers are also gods and their rights are protected,” said Mr. Canh, adding that the Constitution and current laws also stipulate that all citizens have the obligation to respect the rights of others.

The Binh Dinh delegation proposed that the bill clearly stipulate the legitimate rights of consumers, which must first be guaranteed by business organizations and individuals not to be violated, not only by other organizations and individuals but also by other consumers.

Delegate Nguyen Thi Thuy, Vice Chairwoman of the National Assembly's Judicial Committee, suggested considering the regulation, only applying the mandatory regulation to issue a process for resolving consumer complaints for manufacturing and trading enterprises, large industries, and those that have a large impact on consumers.

The reason is that many small-scale businesses or organizations do not have the conditions to set up a complaint settlement department, while if they do not, they will be punished for violating regulations.

Add the subject "organization" to the concept of consumer

Previously, Chairman of the Committee on Science, Technology and Environment Le Quang Huy presented a report explaining, accepting and revising the draft Law on Consumer Rights Protection.

According to Mr. Huy, there are two different opinions on the concept of consumers: one is to propose that consumers include "organizations"; the other is that it is not necessary to include "organizations" in the concept of consumers. After studying the opinions of delegates, the National Assembly Standing Committee agreed to add the subject "organization" to the content of the regulation explaining the term "consumer"; at the same time, add the term "sustainable consumption".

Regarding the rights and obligations of consumers, taking into account the opinions of delegates, the draft law has added a provision in Clause 10, Article 4 in the direction that when using public services, consumers are protected according to the provisions of this law and other relevant laws.

At the same time, to prevent the provision of services that do not guarantee quality, the draft has added Article 36 on the responsibility of business organizations and individuals in providing services (including public services) that are not in accordance with the registered, notified, announced, or contracted content.

The draft law also stipulates that the obligation to inspect goods is carried out in accordance with the provisions of law, and is not mandatory for all products, goods and services.

Regarding the protection of consumer rights in specific transactions, the Chairman of the Committee on Science, Technology and Environment said that the draft law has many specific provisions on the protection of consumer rights in cyberspace. Accordingly, it stipulates that organizations and individuals doing business in cyberspace have common responsibilities; regulations on transactions in cyberspace, transactions on digital platforms, etc.

Regarding consumer rights protection activities of social organizations, the bill also stipulates creating conditions for social organizations to participate in consumer rights protection (including the Consumer Protection Association).

Regarding dispute resolution in court, the National Assembly Standing Committee chose the option of clearly regulating the application of simplified procedures to resolve civil cases on consumer rights protection; at the same time, to ensure that transactions of 100 million VND or more can still apply the simplified procedures prescribed in the Civil Procedure Code...

In addition, the bill has reviewed, adjusted and perfected regulations to ensure a balance of interests between business organizations and individuals in their relationships with consumers.
