Late payment after winning the auction
On August 17, Ms. Nguyen Thi Minh Chau, Vice Chairman of Dien Ban Town People's Committee, Quang Nam Province, signed Document 1929/UBND, advising the Town People's Committee to resolve and respond to the people's request to refund the entire deposit for 70 land lots that 14 people had paid in relation to participating in the land auction at Nam Dien An Residential Area.
Accordingly, after reviewing the citizen's petition, Ms. Chau assigned the Finance - Planning Department to preside over and coordinate with the Dien Ban - Duy Xuyen Regional Tax Department, the Town Construction Investment Project Management Board and related units to review, inspect and advise the Town People's Committee to resolve and respond to the citizen's petition in accordance with regulations.

Previously, on August 8, 2022, Mr. Nguyen Xuan Ha, Vice Chairman of Dien Ban Town People's Committee, signed a decision to recognize the auction results of land use rights for 114 land lots in Nam Dien An Residential Area in Dien An Ward and Vinh Dien Ward, Dien Ban Town.
Of which, 14 individuals won the auction of 86 lots with a total value of 221,484 billion VND.
16 plots of land have paid land use fees on time. The remaining 70 plots of land have paid land use fees late, of which 40 plots have paid 7 days late and 30 plots have paid 10 days late.
In addition, there is 1 land lot, the auction winner is not one of the 14 people above, and paid 1 day later than the regulation.
On September 26, 2022, the Town Department of Natural Resources and Environment submitted a proposal to cancel the auction results of land use rights for the overdue land lots in Nam Dien An Residential Area that were recognized on August 8, 2022.
During the implementation process, the above 14 individuals submitted a petition stating the reason for late payment of land use fees. Because they were in the Northern provinces, they authorized Mr. Nguyen Trung T. to pay land use fees according to the payment notice of the Dien Ban - Duy Xuyen Regional Tax Department.
However, Mr. T. had a force majeure reason, dengue fever, so he paid late. These people requested that the auction result not be canceled, and at the same time, create conditions for the auction winner to continue to fulfill his financial obligations according to the tax authority's notice.
Hope to be resolved soon
On March 24, Ms. Nguyen Thi Minh Chau, Vice Chairman of Dien Ban Town People's Committee, signed Decision 1257/QD-UBND on canceling the auction results of land use rights for 71 plots of land in Nam Dien An Residential Area, because the auction winner was late in paying land use fees according to regulations.
The deposit paid by the auction winner before participating in the auction shall be paid into the state budget according to regulations.
The Dien Ban Town Construction Investment Project Management Board was assigned to preside over and coordinate with the People's Committees of Dien An Ward and Vinh Dien Ward to manage 71 land lots, and at the same time complete the necessary procedures to re-evaluate these 71 land lots.
Dien Ban - Duy Xuyen Regional Tax Department, based on current regulations, cancels the Payment Notices for individuals whose auction winning results are canceled.
People hope that the People's Committee of Dien Ban town will soon resolve the issue of land lots with late payment of land use fees after winning the auction at Nam Dien An Residential Area.
On June 19, Ms. Nguyen Thi Minh Chau continued to sign Decision 3254/QD-UBND on canceling the recognition of the auction results of land use rights for 71 land lots in Nam Dien An Residential Area.
Accordingly, the recognition of the auction results of land use rights for these 71 plots of land is canceled. The reason is that the auction winners of land use rights are late in paying land use fees according to the prescribed time.
Ms. Chau assigned the Finance - Planning Department to advise the Town People's Committee to handle the deposit amount in accordance with the provisions of law; Preside and coordinate with the People's Committees of Dien An Ward and Vinh Dien Ward to manage 71 land lots, and at the same time complete the procedures to ensure the legality to organize the auction of land use rights for these 71 land lots in accordance with the provisions of current law.
Dien Ban - Duy Xuyen Regional Tax Department, based on current regulations, shall cancel the Payment Notices for individuals whose Decision on recognition of auction results has been canceled; coordinate with relevant agencies and units to refund the amount paid by the person whose Decision on recognition of auction results has been canceled, excluding the deposit converted into a deposit.
Immediately afterwards, the people submitted a petition to the People's Committee of Dien Ban town and relevant agencies to issue a decision to refund the entire deposit for the plots of land that had been paid.
Speaking to Nguoi Dua Tin reporters, representatives of these people said that they were very willing to complete the financial settlement after winning the auction. They borrowed money from many places to be able to pay the full amount.
The people's late payment for 70 plots of land has legitimate reasons and the delay is only 7 to 10 days.
It has been a year since the auction, and individuals have been affected, suffered losses in property, time, health, and have had to pay huge loan fees, but the issues related to this auction have not been resolved.
Therefore, they hope that the People's Committee of Dien Ban town will resolve the issue soon.
