Chairman of the Ho Chi Minh City Real Estate Association (HoREA), Mr. Le Hoang Chau, has just sent a petition to the National Assembly and the Government regarding the contents that need to be adjusted in the draft revised Land Law.

Mr. Chau said there are concerns that if economic organizations and investors continue to be allowed to receive transfers of agricultural land use rights or non-agricultural land that is not residential land, even if it is in accordance with land use planning, to implement commercial housing projects, it will lead to budget losses and loss of public assets.

However, the Association found that it was not due to the 2013 Land Law... but the main reason leading to the loss of State budget revenue, loss of public assets, and land resources in recent years was due to the inadequacies and limitations in the application of valuation methods to value land, appraise specific land prices to calculate land use fees, land rents in commercial and urban housing projects, where land valuation is under the authority of State agencies.

Therefore, the key issue that needs to be resolved is to close the loopholes in the application of land valuation methods to value land, appraise land prices to determine specific land prices to calculate land use fees and land rents in commercial and urban housing projects in the articles of the Draft Land Law regulating land prices.

In addition, the Association proposed to add regulations allowing investors to negotiate the right to use land other than residential land, including agricultural land or non-agricultural land other than residential land, according to the provisions of a number of articles in the Land Law (amended), to facilitate and encourage the development of large-scale commercial housing projects and urban areas of tens and hundreds of hectares, to have full functional areas and complete urban utilities and services.

At the same time, it is necessary to consider inheriting the reasonable provisions in Clause 5, Article 1 of Decree 148/2020/ND-CP, in the direction that if the public land area is interspersed in a commercial housing project, then if the land area is eligible to be separated into an independent project, the People's Committee at the competent level shall decide to recover... auction the land use rights according to regulations. In case the land area is not eligible to be separated into an independent project, the People's Committee at the competent level shall recover the land to allocate or lease land to implement the investment project without auction, without bidding...
