Proposal to amend regulations on oil spill response


Voters in Ninh Thuan province proposed to amend regulations on the authority to approve oil spill response plans according to storage scale.

The Ministry of National Defense received a petition from voters of Ninh Thuan province sent by the Petition Committee according to Official Dispatch No. 942/BDN dated November 6, 2024 with the content: "Amending regulations on the authority to approve Oil Spill Response Plans (district and provincial levels) according to the storage scale for petroleum business establishments to facilitate the appraisal of oil spill response plan dossiers".

Regarding this issue, the Ministry of National Defense said that in Clauses 2, 3, 4, 5, 6, 7, 9, Article 7 of Decision No. 12/2021/QD-TTg dated March 24, 2021 of the Prime Minister promulgating the Regulations on oil spill response activities clearly stipulate the responsibility for developing plans and the authority to appraise and approve oil spill response plans for each subject.

Binh Son Refining and Petrochemical Joint Stock Company (BSR) practices response plan for oil spill and fire emergencies at the product export port.

Specifically, the provincial People's Committee develops a local oil spill response plan and submits it to the National Committee for Incident, Disaster Response and Search and Rescue for review and approval. The local oil spill response plan is updated annually and re-approved every five years.

Local ports, facilities and projects shall develop oil spill response plans and submit them to the provincial People's Committee for appraisal and approval. When there are changes in conditions leading to changes in the content of the oil spill response plan, it must be updated annually; when there are major changes that increase the capacity beyond the response capacity compared to the plan, the plan must be re-established and submitted to the competent authority for approval.

Offshore oil and gas facilities and projects develop oil spill response plans, report to Petrovietnam for appraisal, submit to the National Committee for Incident, Disaster Response and Search and Rescue for approval and notify the People's Committees of provinces at risk of being affected when an incident occurs at the facility or project.

For petroleum depots, petroleum depots with a total reserve volume of 50,000 m3 or more, petroleum ports capable of receiving ships with a tonnage of 50,000 DWT or more, develop an oil spill response plan and report to the competent authority for appraisal (for petroleum depots attached to petroleum ports, develop a general oil spill response plan for the depot and port) and report to the National Committee for Incident Response, Natural Disasters and Search and Rescue for approval.

For local ports, petroleum depots, petroleum depots with total reserves of less than 50,000 m3, petroleum ports capable of receiving ships with a capacity of less than 50,000 DWT, develop an oil spill response plan, report to the competent authority for appraisal (for petroleum depots attached to petroleum ports, develop a general oil spill response plan for the depot and port) and submit to the provincial People's Committee for approval.

For petrol and oil trading establishments with only a small risk of oil spills on land, on rivers, and at sea, develop an oil spill response plan and submit it to the District People's Committee for approval or the competent authority for appraisal and approval according to regulations (for petrol and oil trading establishments not under the management of the District People's Committee). The plan is notified to the District People's Committee for coordination in implementation.

Oil tankers flying the Vietnamese flag with a gross tonnage of 150 GT or more, other ships other than oil tankers with a gross tonnage of 400 GT or more, have a shipboard oil pollution response plan approved by a competent authority of the Ministry of Transport; oil tankers flying the Vietnamese flag with a gross tonnage of 150 GT or more participating in ship-to-ship oil transfers at sea have a ship-to-ship oil transfer plan approved by a competent authority of the Ministry of Transport.

In addition, Ninh Thuan voters also proposed to supplement regulations on necessary equipment and means (minimum) for owners of facilities, ports, projects, petroleum depots, petroleum warehouses (petroleum business entities; oil tankers, other ships; ports, etc.) to invest in purchasing to ensure prevention and always be ready to respond to and overcome oil spill incidents.

Regarding this issue, the Ministry of National Defense said that, in agreement with voters' recommendations, the Ministry plans to amend and propose the Prime Minister to promulgate it in the second quarter of 2025.
